If swinging the controller is just a trigger for a predetermined swing, it accomplishes nothing more than could be done by pushing a button, and they've missed the point. Wii Sport Resort swordplay is very close, but I don't think it's been done in a "real" game yet.
I'm under the impression that the iStore or whatever is the ONLY place that you can get content for your iPhone/iPod/iThing. In which case your analogy doesn't hold. However, you could argue that you were agreeing to Apple's censorship when you decided to purchase your iShiny in the first place, so you've got no right to complain.
In about five years I'm going to come up with this great idea to actually use physical "buttons" to control things. Everyone will be clamoring to use my "pushbutton" technology to replace the ubiquitous touchscreens that everyone has come to despise so much.
