    These people have been killing each other for centuries

    This is pure rubbish. Ethnic tensions do exist in the region -- as in everywhere else in world where different ethnic groups have to live with each other (e.g. the USA). But the people in the Balkans have had centuries of peaceful coexistence. The current conflict was created by Milosevic who capitalized on the power vacuum created by the death of the former Yugoslav dictator, and exploited existing Serb nationalistic sentiments to create his own brand of destructive ultra-nationalism.

    These people have been killing each other for centuries. The same line was used in Rwanda to justify inaction ('Ancient tribal hatred' this time--it was not, it was systematic slaughter organised by the extremist factions in the Rwandan government .). This is an old excuse used to evade responsibility for action when humanitarian disaster occurs.

    You're very badly misinformed. Many Kosovo civilians have been systematically eradicated by the Milosevic regime. You admit that there's murder going on; large scale massacre of an ethnic group is genocide.

    Let me quote you Article II of the Genocide Convention (which has been ratified by most countries in the world):

    Genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:
    (a) Killing members of the group
    (b) Causing serious bodily or mental harm to members of the group
    (c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part
    (d) Imposing measures intended to prevent births within the group
    (e) Forcibly transferring children of the group to another group


    (a), (b) and (c) certainly apply here. Destruction of Kosovar homes, thus forcing their exile alone constitutes inflicting serious mental harm (b) and creation of conditions designed to bring about physical destruction (c) of the ethnic Albanians.

    Milosevic's actions may not rise to the level of genocide (although I think they do), but his actions are unquestionably henious and must be stopped.

    You're also suggesting that the US govt. is deliberately making this up. That doesn't make sense at all. Taking part in a conflict which the US has little direct interest in hardly does wonders for Clinton's popularity.

    In fact, Clinton has repeatedly tried to justify intervention to the American public by making weak arguments to tie it back to (narrowly-defined) American national interest, because he believes that the American public is not right-minded enough to support purely humitarian intervention (which is what it is, and what it should be).

    You musn't be getting any news at all.

    A civil war is where 2 or more parties battle for political control of a country. This is not what is happening in Kosovo. What's happening there is a case of genocide, where one ethnic group attemps to eradicate another. This is Milosevic's response to Kosovo's claims of autonomy (which they had, till Milosevic took it away about 10 years ago). And note that secession and movements for autonomy are concepts distinct from civil war.

    The lie that what's going on in the Balkan's is civil war (and therefore we can't really do anything, etc. etc.) is a convenient excuse that has helped the international community evade responsibility for a long time now.

    Gassee has no intention of giving away free copies of Be, and he knows that he will not be giving away any copies of Be. If he does, why does Be not offer the OS for free to any computer user who asks? He should, if he really believes in the "network effect" he talks about.

    This is just a cheap publicity stunt. The OEMs know that this is just a cheap publicity stunt -- therefore they will not install Be (there are many hidden costs besides the price of the OS). Therefore Be is the winner: Be gets good publicity, Gassee gets back at Microsoft, and he does not have to give away a single thing.

    That's pretty cunning of them ... it subtly potrays the whole refund day saga as action by a special interest group (Linux users), and not something that most people want (which is probably true).

    Then there must be something wrong with GNU's philosophy. It's ironic that while GNU opposes copyrights, the GNU Public License is in fact a form of copyright, basically that authors ought to have the right to do what they wish with their works, in this case give it away for free -- which is what copyrights are about, respecting the rights of the authors.

    It's hard to imagine a more egregious violation of the rights of a person than to demand that he give his work away for free. If you choose to give away your work for free, well and good. If not, it's your choice and no one should be able to tell you otherwise.

    Of course, RMS argues that copyrights are not a fundamental right. After all, the American constitution sees this as a practical thing, a device to stimulate creativity. Open source advocates say that they're willing to work for free. Well good for them and good for society. But the fact is, most people aren't so altruistic -- so copyrights remain a necessary device, and recognizing and working with the limitations of human character is the hallmark of a practical, functional Democracy; doing otherwise would be an experiment in Communism.

    But practical issues aside, it is hard to see how we can have a free society where the rights of authors are not respected.

    That's probably true. But since they've already paid Microsoft for the license,that doesn't make them very keen on shipping other operating systems. It probably costs them more to ship a blank hard drive than a hard drive with Windows, because it disrupts the normal assembly process.
    I think this is a perfect example of Microsoft's stranglehold on the industry.

    There seems to be a problem.. the EULA does not say how much they have to refund you. It could be $0.50, or maybe nothing at all. They can argue that if you had made it clear that you did not want Windows, they would have sold you the system without Windows for the same price anyway. And furthermore, OEMs do not pay the full retail price for Windows.
