When I bought my second hand Atari ST back in 1997 it came with (among other things) a 3D sculptor/renderer called "3D Cad" or somesuch. Some operations took a long time to complete and therefore the friendly programmer had supplied (TaTah!): A progressbar...
I believe there are lots of even earlier textbased implementations around. Turbo Pascal comes to mind?
The IBM "patent" is from 1990 and therefore clearly not valid.
Perhaps the poster wasn't told wrong, just didn't remember it completely right:-)
Think about it. If you record a 22Khz sine and get a representation with two nonzero samples for each cycle, then what will you get if you record a cosine instead? Digital clearity? Or "the sound of two zero-crossings clapping?"
If you had used 4x samplerate instead (as the poster suggested) then the phase of the signals individual parts would no longer be such an issue, since there would always be at least two "buckets" ready to catch the nonzero part of the signal.
Those of us visiting groklaw now and then, might realize that the so called "evidence" is produced by people working inside. If I had the powers I would give any of those guys a new job. Right on the spot!
To me it seems like those people getting upset about this story, are living under a government that would not hesitate to use such a device for whatever reason comes to mind (even none). And probably the only people that are (kind of) threatened by this device are excactly those same people, so...... ehrm, how to say?
Frozen water is called "ice". Ice is not wet unless it melts and becomes water again.
That other thing related to water is called "steam"...
So, the analogy is still valid.

There is no exact limit to where copyright infringement starts other than a "substantial part". This is often interpreted as four bars, which (in popmusic) translates into eight seconds or some such.
I doubt your ringtone is eight seconds long. You would't live to hear it...
In order for Linux to be useful as an audioplatform, latencies must be brought down to a minimum. As of this writing HD access will postpone just about everything, including MIDI.
We need to put the serious audio/midi drivers into RTLinux and run Linux/X as a sideshow on top of that.
Yesterday when I browsed thru the norwegian copyright laws, I noticed that one is allowed to do whatever it takes in order to get access to a database that one owns or has licensed.
So if the judge can be convinced that a DVD is just a pile of data and therefore the equivalence of a database, Jon should be pretty safe.
Mmm... Would this work in the US as well?

I agree that taking out a patent on e-commerce in general is.. simpleminded! Some of our folks are learning from the big boys on the other side of the pond;)
I am european, and I have often been amazed by the claims of american patents. There is no way that any of these claims will ever hold up in court! All you guys are doing is making a laugh of your selves in front of the global community.
Please put an end to this abuse of the US patent system
