Sometimes in those cases personality tests are used even if they ask questions that would normally not be allowed. The information that usually has no connection to a job (i.e. "My sex life is satisfactory") becomes valuable for the employer to know since its used by this test to inform about overall personality traits.
But if you just go to apply for a normal job in an office or a factory or something and they ask you about your sex life, or if you're gay, or even just if you're married, its probably a violation.
