    No, this ruling is just what the trademark is about. They were first to claim the name. So they get to use it. The amount of money an infringer on such trademark spends to get people to think they come up with the brand doesn't matter at all.

    I might be slightly paranoid and I hope I am wrong, but why would big pharmacy want to produce this? They have a choice between selling someone a whole life really expensive medicines (well not to make, but to buy) or cure him... I am just going to assume that this method will be deemed 'unsafe'.

    The big game-companies and the indies know that only newly bought pc's and laptops will have win8. Nobody else is going to make the switch and I assume a majority of new buyers will 'downgrade' to win7. So they won't develop for it. Maybe they use the api as a extra option, but they all will make sure their games run on win7. Because win8 is going to be the new ME/Vista. Nice on tablets, but keep that crap away from my desktop.

    Should force Apple to remove it's homepage with one the Judge himself sees fit. I imagine scaled fonts up to size 340 that tell everyone: HI WE ARE BASTARDS AND LIED AND LOST ABOUT IT IN COURT. SAMSUNG PRODUCTS ACTUALLY ARE MORE VALUE FOR THE MONEY. Something like that. Just to make an example that you don't fuck with a court-ruling. Because what Apple did and still is doing (scrolling to see the court-ruling) is pissing on our all. Our laws, fairness, and rights.
