    1. The infringers claimed RMBS did not invent the technology. It is now law that they did.
    2. The infringers claimed there was prior art. It is now law that there was not.
    3. The infringers claimed there was fraud at JEDEC. It is now law that there was not (by RMBS).
    4. The infringers claimed they did not infringe. It is now law that they did and continue to infringe.
    5. Now the infringers are admitting 1-4 above but claim they should not have to pay for the use of the technology they have been stealing for over a decade because they claim RMBS destroyed documents but cant point to any prejudice they suffered or any evidence of bad faith.

    Ironically Rambus had implemented such a policy recommended by an outside legal counsel at the time. It was 'sticking to this policy' that caused them to hold the shred day clean up / pizza party that got them into the trouble. One of the verdicts in Delaware which was overturned had previously resulted in forfeiture of their patent rights entirely.

    The U.S.A. cannot compete with 3rd world, Eastern European, and Asian labor rates for manufacturing anymore. Their GNP is closely related to Intellectual property which can easily be 'stolen' without strong intellectual property laws. Knockoff products and cloned trademarks are eating into American's livelihoods. Outsourced manufacturing of commodity products serves to teach foreign factory owners how to improve quality and target higher end goods and production methods. I support strong intellectual property laws with fair royalties to compensate knowledge workers for their labour.

    Wasn't Barrack Obama's right to keep his Blackberry after he became President questioned because the server was hosted in Waterloo Ontario, at Blackberry's headquarters in Canada ? Blackberry's elliptical curve encryption algorithm ( formerly from Certicom) must be pretty tight.

    This is a personal observation only but I am a reasonably tall person at 6 feet 2 inches and I normally drive a SUV (Jeep Grand Cherokee) but on occaisions where I rent a vehicle I often get a Toyota Corolla. Several times in these rental vehicles I have found that A. The distance between Steering Wheel and pedals is too small, My knee hits the wheel when I am moving my foot from gas pedal to brake and B. The pedals themselves I find too close together. One time this resulted in my climbing the curb while driving in to a parking spot. This is not only a problem with Toyota Corollas but many 'Compact' and 'Mid size' sedans as defined by the rental companies so I always specify a Full Size.

    As others have said the establishment lawyers keep bringing back the same old laws hoping to eventually wear out the resistance of the majority who continue to carry on pirating to their hearts content. Civil disobedience is the last refuge of the oppressed majority who eventually will rise throw off the shackles of slavery to the suits.
