Battle.net will generally keep your account past 90 days and beyond until someone tries to create an account with the same name, in which case it will hand it over to that user.
This is evident when using "/stats " on an account that is over 90 days old. You will still get the account's game record, but if you go to register it, the account is reset.
They do not use the same system for Diablo II (realm) characters.
