Well I don't necessarily think that it would prevent the product from being sold in the US. MS would just have to go about it a different way.
DeBeers (yes, the black and white diamond commercials) is considered a monopoly. They own over 80% of the market around the world. However, based out of somewhere in Europe, they still:
a) market their product (heavily) in the US b) manage to sell a truck-load of diamonds c) still make billions of cash-o-la
It would hurt the price point, but it would solve the problem.
