To be precise, Justice Holmes wrote that "(t)he most stringent protection of free speech would not protect a man in falsely shouting fire in a theater and causing a panic." [FN91] The point of Justice Holmes' example is not that any kind of speech that might have harmful long-term consequences can be banned. Rather, the question is whether the speech makes impossible any reflection on the part of the audience, and thus impels instantaneous action. In a theater, when someone yells "fire," people will not have an opportunity to investigate and make their own determination about whether there is a fire; rather, they will head for the exits posthaste, perhaps trampling others in a panic."

Now that BSDI and FreeBSD are in bed with each other what is the diff? I'm just getting started with BSD (after a few years with Linux) but would it not make sense that the BSDI stack and the FreeBSD stack are now one and the same?

You should get the O'Reilly Mindstorm book it has some very very cool ideas.
This is very true when I worked tech support for a ISP *everything* was our fault because they wanted to use tha machine to connect to the Internet. Very very true.
Bazarr ESR says that you should release as soon as you have a working version. I'm thinking *very* late alpha early beta here. It gets people early but also late enough that they can see that this will be cool.
who thinks this "I'd pay a micro-payment to yank banner ads from websites I frequent" is ironic.

So according to you if I post death threats on/. then Rob is liable........ Or if I post illegal content on a webpage hosted on one of my ISP's boxen then the ISP is liable. Uh I don't think so.
The entire idea that MP3s cost sales and therefore money is not true in all cases. There are very many of us who download MP3s of albums that are out of print and also of bands who have one or two good songs but the rest of the album sucks. The RIAAs argument is that if the MP3 was not there that we would all be buying the album this is untrue if the MP3 was not there many of us would just do without the song. All of the numbers that I have seen that indicate a loss in sales are based on the formula MP3download=lostalbumsale. This is *not* true for many reasons.
The problem with this line of reasoning is outside of techies 99% of the population do not know the name structure. I have many people every day who try to go to www.foo.net.com for a website that I have something to do with because they can not understand that a name can end with something besides a.com the whole.org.net.com thing was a good idea but the great unwashed masses have ruined the whole concept.
No you have to make is possible for them to get the source you do *not* have to give out the source. Read the GPL: Accompany it with the complete corresponding machine-readable source code, which must be distributed under the terms of Sections 1 and 2 above on a medium customarily used for software interchange; or, b) Accompany it with a written offer, valid for at least three years, to give any third party, for a charge no more than your cost of physically performing source distribution, a complete machine-readable copy of the corresponding source code, to be distributed under the terms of Sections 1 and 2 above on a medium customarily used for software interchange; or, c) Accompany it with the information you received as to the offer to distribute corresponding source code. (This alternative is allowed only for noncommercial distribution and only if you received the program in object code or executable form with such an offer, in accord with Subsection b above.
with the binary what it does require is that you make a written offer and provide a means where by they can get the code in the *same* format that they got they binaries. I quote "Accompany it with the complete corresponding machine-readable source code, which must be distributed under the terms of Sections 1 and 2 above on a medium customarily used for software interchange; or, b) Accompany it with a written offer, valid for at least three years, to give any third party, for a charge no more than your cost of physically performing source distribution, a complete machine-readable copy of the corresponding source code, to be distributed under the terms of Sections 1 and 2 above on a medium customarily used for software interchange; or, c) Accompany it with the information you received as to the offer to distribute corresponding source code. (This alternative is allowed only for noncommercial distribution and only if you received the program in object code or executable form with such an offer, in accord with Subsection b above." So you just put a link on your page to a copy of the code tarball, zip, and whatever the Mac uses and you are well within what the GPL demands. Get a copy of the GPL and read it it is really quite easy to comply with.
I work at a very large company here in Utah and it just iced over in our tech support area. As someone who lives in Hatch's home state I am shocked and amazed that he took the right stand on this. I hate him a little bit less now. Oh by the way the streets of SLC are also ice covered.
Scorched Earth This should be moderated up to 5 it is the best Turned Based Strategy game ever period.
Ooops on the links sorry

Yes the next President will appoint a few justices but the odds of that happening before this case went there are minimal. IMHO

We already have a couple my son loves them he is 51/2
Try this I and several other people I know use it on a regular basis.
don't own most of this music the RIAA will still complain about it and be exposed for the bastards they are. At least this is what I hope will happen.
