    Congratulations, Michael. You've managed to link to an article which:
    • Analogises the crime of copyright infringement with the crime of rape.
    • Analogises the prosecution of people for copyright infringement with the wholesale massacre of Jews.
    • Wastes half of its length on a boring anti-gun-control rant utterly unrelated to the topic, and
    • Destroys the entire case for freedom of information by claiming that hackers should be seen as analogous to mobs killing each other in Chicago (I am not making this up -- the fool's argument is that if hackers want to break the law they will do no matter what the law, therefore they should be allowed the tools to do so)
    Quotes like "It's impossible to favor gun regulations and oppose computer regulations and remain philosophically consistent. " are calculated to get half the reasonable people in this country thinking that the DMCA must be a good thing after all, and the linked article's author is a prick of the worst kind for trying to hijack a genuine issue of liberty for his own half-assed political program. Even Eric Raymond has always had the common sense not to stoop this low.

    I always wondered whether there was a site out there with worse journalistic standards than Slashdot. Michael's found it, and he's linked to it. Congratulations.

    For 99% of the funky world, it's a typewriter with a calculator built in, and an Atari games console on the weekends. How much experience do you need to use any of those things?

    In any case, people do spend a lot of time learning to use their computer. It takes a lot of time to learn to use Word and Excel as efficiently as the average secretary (if you don't believe me, try it sometime). That's the time they have to learn their computer.

    Slashdot shits its pants in public by not reading a judgemetn properly. This was a case where the full court reiterated a decision made in an appeal last year, whereby they ruled on a lower court's interpretation of what the patent claimed. They have made no ruling on whether the patent is valid or enforceable; merely that it claims what the plaintiffs say it claims. "Upheld, my ass". The quote at the end of the original cnet story says it all.
    "This case has a long way to go yet," said attorney Daniel R. Harris, a patent expert and a partner at Brobeck Phleger and Harrison. "All the (federal court) did was look at the language of the (lower court's) finding and decide it was too narrow. They still have to figure out if the patent is valid and whether or not the defendants infringed on the patent."
    This ruling is just the same court, saying the same thing as it did before, this time with all its judges present.

    Martin Niemöller's famous and often (mis)quoted statement - "When Hitler attacked the Jews I was not a Jew, therefore I was not concerned. And when Hitler attacked the Catholics, I was not a Catholic, and therefore, I was not concerned. And when Hitler attacked the unions and the industrialists, I was not a member of the unions and I was not concerned. Then Hitler attacked me and the Protestant church -- and there was nobody left to be concerned" comes to mind. But remember, they didn't actually come for the Jews first. They came for the gun owners even before the jews - in 1938.

    Often misquoted indeed -- Niemoller referred to "them", rather than to Hitler, started with "First they came for the Communists" rather than the Jews and never mentioned the Protestant church.

    Oh yeh, and Hitler did not "come for the gun owners" for the very good reason that privately held guns were already illegal in Germany by the time he took over, and had been since the First World War.

    Other than that, your post only has grammatical errors.

Can you demonstrate that (for example) Jenna Jamison doesn't actually enjoy what she does? How can you prove that an afternoon of athletic three-holing doesn't constitute an enjoyable "day at the office" (as it were?)

    The statistics regarding mental illness, drug addiction and suicide in the industry have a certain (shall we say) suggestive quality.

    Speaking for the world here, nobody wants to stop you from looking at porn, nor even from wanking while you do it.

    We're just saying that we're sick and tired of having to also keep on reassuring you that we think you're a swell guy for doing so. In actual fact, we think you're a little bit of a bore (like the guy who spends all his time with his stamp collection), and that you tend to make some fairly silly political arguments. We also think that your industry is not "nice", since it involves the transformation of something which is generally at its best when performed as a mutual, co-operative act into a solitary, commercial transaction. But we usually don't like to say so.

    The thing is, if you don't like criticism of pornography (or masturbation thereto), as you say, Don't read it! We have no problem not looking at pornography; we're not obsessed (you're confusing us with you). But you don't seem to be able to exist without constant reassurance that you don't need to be ashamed of anything. And that's becoming a little bit tiresome for us to provide. From now on, you're on your own. Whether you feel ashamed or not of your habit is entirely your own decision, and you can no longer count on us to tell you that porn is A-OK. Sorry and all that, but it's tough love.

    Also, given that you're a perfectionist, you'll be appalled to hear that someone has been using the "CmdrTaco" identity to post poorly spelled, ungrammatical crap all over Slashdot for the last three years. That same person has always tried to justify himself by whining that he "doesn't care about that stuff" and "doesn't want to be too fussy". This may or may not be the person who wrote the notoriously buggy first release of Slash, and said that it was "close enough".

    But of course that couldn't be you

Yahoo is claiming, in the face of all the technical evidence (and indeed of their own "targeted advertising" claims), that it is impossible for them to identify French clients to the satisfaction of the court.

Therefore it is under the obligation not to carry out acts which are illegal in France. Selling Nazi memorabilia to French citizens is illegal in France. Selling Nazi memorabilia to US citizens is not illegal in France. Yahoo could make an effort to stop breaking the law in France, but it didn't.
