But if they are hanging out at the Taliban Tavern drinking a pint of Osama bin Lager with their mates, possibly planning the next 9/11 attack, killing them then is a summary execution rather than an act of war. I think the ACLU has a point that we should investigate, arrest and try them rather than summarily executing them.
