Personally I hope the Patent office continues granting MS patents that have such prior art ---- two things will happen -- 1) it makes the patent office look to be a joke and can be used in court against patents in general and 2) makes MS look to be even more a fool seeings how they really should know better then to file such patent applications for such prior art stuff in software...
.... linux, OSS, FOSS isn't an economic system, Its SOFTWARE and made and used by the efforts of people from many different economic systems and government rule.
I wonder how many people know what communism identifies. Its a totalatarian government and a socialistic economic system. Thats the simple definition of communism.
But again, its software, not an economic system or even some government rule.
If there is anything that might be closer to NOT being a non-sequiter, it'd be to say OSS is HUMANITY...
Isn't all that is really needed just a landing of a main transmitter/receiver along with what amounts to a bunch of ant or roach like robots that go out in various directions and transmit back to the main transmitter that relays it back to NASA?
To increase the overall data collection.
Looking for signs of life on mars.... hummm... that could pose a problem, if the small robots see eash other.
Oh hell screw it, lets put life there, wouldn't that just solve the quest for life on mars?
This is really not about extrapolating from where we are today to create science fiction, but rather about finding some inspiration...
Its been said that the first Sci-Fi movie ever created had all the plots and themes incorporated in it - Metropolis by Fritz Lang
there are new generations of humans and just like other markets have realized much can be recycled as far as ideas go, simply because its "new" tio the new generations.
Oh no, I just inspired someone to write a science fiction about a master races that lives much longer than us humans and is fully aware of this mental limitation of ours that allows them to watch reruns of our antics...
though FOSS came along something like a decade after the introduction of proprietary consumer/commercial products, we are still talking not even thirty years old the consumer/commercial computer industry is.
That's still quite young for an industry. And there is yet to be realized any real industrialization of software development.
So what is going to happen when the level of abstraction in software development ease of doing, becomes at least a young adult? (currently its still a kid playing head games in marketing).
I think its only logical that an open base line of well established software will contine to grow. Even if it was only a matter of expiring copyrights and patents... thanks to FOSS I won't be dead and long gone when better things finally come, or at least I'll be able to experience better due an improved open base line..
A good indication of this is that MS is now being forced to improve their products due to linux competition, rather than playing non productive games.
So, its possible something will happen that changes everythings, say for example autocoding of a level that anyone who can use a calcuilator can program... leaving far more challenging innovation up to the real software engineers (rather tann the psuedo coders). In this event you have programming as a part of ones other duties...just like using a calculator...
The calculator didn't put scientist out of work, but only allowed them to even way cooler stuff...

Problems - all-around lack of complete documentation and weak training, faulty user input and feed back - self contradictory user request, lack of project leadership between developers and users, management created problems and low quality control standards, feature creep and software size increase, advancing technology rate of change and lack of general standards, solutions around the corner but never arrive and our tools are better than theirs attitude, lack of a value chain structure for value added abilities, failure to produce a functional model before coding and constant remodeling, etc.

---- A Few Comments from Panel Members ----
A culture needs to evolve that respect software engineers as crafts-people. Writing code is not just writing code but like the field of writing where you have technical, creative, documentary, etc., there are different types of code writing. (Authors' note: I agree with this but also realize end users are even more specialized in what they need and do. Respect for the end user needs and abilities is needed even more so. Without respect given to the end user, the software engineer will not be given respect in return.)
A fundamental change in the programming environment needs to happen that allows the tools to work together more. (Authors' note: the panel member making this comment, did not specify what tools or who the tools would be used by. It was a very general comment pointing to a fundamental programming environment change. A lead in to the concept of componet programming. But, there was no recognition given to the concept of componet software or componet applications. At least not in the sense of being outside of "plugins". Read on!)
Jokingly - one of the best ways to copy protect software is to put it in a dll, give it an obscure name and put it in the windows system directory. Because you'd never find it. (Authors' note: This does not make it any easier for the end user in keeping their system organized, clean and optimized. This attitude of constraints, though humorous, cost end users alot.)
The meaning of "intellectual property" became questioned. Did it mean you take the best ideas or something owned? (Authors' note: it was the panel supporting "best ideas" but wouldn't the correct term for this use be "intellectual value" rather than "intellectual property"? What would happen, regarding this, in a court room? The audience member whom brought this up, was a bit angry about the distortion. Her question was: Is it the developers whom are creating the problems? And what are the developers going to do about it? The responce was "that's not the problem!")
Users shouldn't develope software but know, better than the developers, what they want and need. (Authors' note: users don't have the time to write code, it's not their job or duties!!! I can cut the lawn, I know how, but if I don't have th
" Dude, the software factory concept is way older than 1996. I don't think MS give a shit about whatever crap you dreamed up."
Ok then I'm sure you are willing and able to show the evidence of your claim, so how about it?
But you won't because you can't.
Perhaps you should better follow the links and read what all I have pointed to, then you will know the falacy of the software factory and why FOSS will always be able to beat out MS, though this should be a good hint as to what MS is up to in their patent grab.
FreeSoftware will only become genuinely free when it is easy enough to create that anyone, regardless of their resource limitations (knowledge, time, etc.) can create it, from simple automations to improve their personal productivity level to full application programming. This is based upon the primary concept and purpose of programming:
Programming is the act of automating complexity in order to make the use and reuse of the complexity easy for the user of the complexity. Programming is a recursive act, as shown by any code/programming being done above machine language. And it follows that it is of such recursion that Software will become genuinely free, or otherwise contridict its own primary concept and purpose.
Or in other words, we don't need no stinking sweat shop software factories, we only need a general population understanding of the physics and nature of software development or general automation, and the non-patentable tools that allow us all to cause a generation of code based upon our design.
BTW, due to teh changing nature of the internet and how long ago the above link content was created, some the the links within those will not be available.... but you can use google to find the information and its new links
... to solve the software patent problems will require giving the patent greedy what they want to the point of it being obviously stagnating and of no use to them. While not allowing them any way out but to dump the whole thing.
For that is what they can understand. It is apparenytly beyond them to understand any scientific proof to the contrary of what they want.
.... is that bits and bytes don't deteriorate, but only can be made obsolete with newer hardware technology and that has a limit to, as far as the consumer market goes (typically the gaming industry is where to look for advancements)
There is also programming techniques, languages etc. that make things easier and easier to develop. The dot net core technology for example is a sum of the majority of programming concepts and data types put together in a non-conflicting manner, so that any language created to be compatable with the intermediate language (the point of translation from human based to machine based) can make use of the dot net run time engine. Point being: the field of programming is stablising in concepts and datatypes.
Then there is the point of programming, to make complexity easy to use and reuse by the users of that complexity, via automation of the complexity, and this is recursive from the assembly programer to the end user putting some script (VB?) to automate sme task of theirs.. Where the essence of this "make easy to use and reuse" will most certainly lead to a "working oneself out of a job" result. (NOTE: Unless you take the MS attitude of "making people need you" and accept the resulting manifestation of the "user frustration function" in teh sum product)
The field of computer technology and programming are very young still, younger than still many who helped get it going. And it will grow up beyond the sand box bully of MS mentality.
From a technology point of view, there is a limit as to how complexicated you can make this "abstraction calculator" where the rest is really up to the end users to decide what all they want to figure out with it or use it for.
SO, where all this is leading is to the REAL and GENUINE "New Economy" where the market is not of IT or programming (though there will allways be a genuine profession of software engineering -- not the more popular psuedo coding).... But where the market is in better using this abstraction calculator within the industry and field of your non-IT position, so as to improve your own productivity.
To draw a picture:
What would the many industries and fields of, do with computer technology of such ease of programming and depth of complexity as one might consider the holodeck (star trek).
The new market is not in reinvention or psuedo coding, but found beyond this. The virtual reality integration of all we have, in detail, so as to go beyond the limits of our IT/programming methodologies of today. Like how we went beyond teh limits of roman numeral accounting when we adopted the hindu-arabic decimal system with teh zero place holder.
Is FOSS and all other freely distributed media all the sudden non existant or somehow not included in consumer choice?
If the markets are really going to tell the story then what should it say in the even more and more consumers move towards that which needs to regulation?
I guess maybe its a vote for "none of the above"???
But what of the tax payer monies spent on such, if the majority doesn't need or want it?
""Greed" is a subjective label for some aspects of human nature -- and human nature is basically timeless. "
Actually that is a falacy. For man wasn't always in such an evolution state as to allow greed.
The key driving force in mans evolution is that of population growth and survival.
Julian Jaynes book " The Origin of consciousness in the breakdown of the bicameral mind" covers the identification of consciousness, its turning on point. Where man discovered he can now lie.
We are approaching the next phase of human mental evolution. There are many symptoms in teh form o0f conflict and difficult or impossible to find solutions to problems under the given mindset and the solution will require a mental change.
To use an analogy, like moving from roman numerals to teh decimal system having teh "nothing can have value - difficult concept to grasp" of zero the place holder. Where math was made so much simpler and available to far more than the roman numeral accountants with their vested interest in that field.
So yeah, we have lots of problems boiling up, like patent issues on software... etc... but they all have the status of "symptom" of a bigger and more general mindset problem.
The stock market was intended to provide companies with capitol to build from, but todays stock market game has become so abstract that teh idea of investing in a company you like or approve of the products and services they make over just going thru some IRA investing house playing teh market at high levels of abstraction..... How many IRA investors have any clue as to what they're investment is funding?
Greed is only a problem because we have created a model that supports it called capitolism.... which is not truely "free enterprise"
It should be noted that China was teh only country that didn't feel the impact of the trillon dollar bet..... and the reason was simply that they weren't playing that game. Making them the proof..
The stock market game has become a way to transfer wealth without production.... and thats simply not contributing to the overall rate of improvement we can achieve.
Maybe the question is:
What is greed?
IS it the king who gathers up all teh wealth in his land into his castle... or the king who keeps the wealth within the community of his people?
Which has greater potential of growth? Which is safer from theift, and who would be the thief?
Solve terrorism by not stealing from people but rather genuinely help solves problems.... where nobody will be able to muster up enough support to be a threat..
But the the power monger very small maniority would have to get a real job and actually produce something.
If a loon is defined as not being of the general population, then fine considering the ratio between teh experts and teh general population adn lets not forget about John Nash (nobel prize winner) or what it was he got the prise for.
How does it go? Something about not being greedy enough to be blinded by the fact that we are all in this together and that by working towards common goal AND individual goals we can achieve more than by focusing on only our individual goals.
Anyone who is going to babel non-sequtors about misspelling and what one guy did (is he god?) over the fact that most on the internet are not trained typest or teh best of spellers while ignoring that its an error to be put in awe of the accomplishment of one or a few that then blind you to your own potential accomplishments........ is simple looking for an excuse to keep things unchanged for their own self destructive but blind to, ways.
Teh point is, you don't know what you are missing out on because you work against better.
The manelbrot is a simple mathmatical formula..... but its not the holy grail.
Nor was I the one who wrote the transcript of the PBS documentary...
Greed is not a human character, but of something of a lower humanoid species 6that requires self deception...
Yeah sure everyone wants the majic formula regarding financial matters, but here is what happened last time - trillion dollar bet gone really bad --- like where do you think the dot com money came from, where did the enron, worldcom, etc.. money go... easy come easy go??? and teh economic caos it caused and lead to world economic problem and yes... even the war crap we are in now...
SO NO to trying to find the next magic financial formula.... at least until we really much better unberstand and nutralize GREED!...
Or do you really want to help teh few be greedy and take from the many, what they have themselves NOT honestly earned?
I don't care what its called or how sweet it sounds....untill greed is checkmated... there is no formula... only illusion and dillusion..
Its become clear to anyone who has been on for a few years that the internet has a negative tendancy.
This is a result of, or indication of, the level of maturity or immaturity of its general users.
There are alot of things that fuel this, from those going online to release their work day frustrations by dumping it on others, who probably live in some other country which makes law suits even more difficult.
And there are those who like to play games and can hide behind teh online mask they wear..
I'm sure there are alot more reasons, as many as there are those contributing to the problem, for the bias of the internet towards negativity.
But its a limited media too, where mostly communication is typed... making it a two deminsional media that somehow is supposed to represent three and even four deminsional people.
IS the question, "have you ever been misunderstood in something you wrote, via the internet?" better written as "When was teh last time you were misunderstood in what you wrote thru teh internet?" ????
Its so much easier to argue and flame others then it is to really understand them thru this two deminsional media.
There was a time when usenet was made up of computer savy people and decussions were productive but today its gone even beyond negativity into the mess of mass spam...
I was once threatened with a lawsuit (the guy even got my phone number and called me) by a guy who thought I was involved in the production fo the matrix trilogy.... But I wasn't though he did pursue a lawsuit against quite a few that were.
Don't know what became of it but it showed up in legal proceedings found thru such services that search legal proceedings..
Hmmm, maybe there really is a matrix, this internet of negativity....
.... and it is my conclusion that he did not come up with anything but rather this is just a way to try and establish/fabricate some legal stack of paperwork in an IP grab of something outside of the whole thing.
Note the last paragraph: "Protection of industrial property is not an end in itself: it is a means to encourage creative activity, industrialization, investment and honest trade. All this is designed to contribute to more safety and comfort, less poverty and more beauty, in the lives of men."
And consider how FOSS supports that better then what MS has been proven to contridict that, in courts around the world.

Shyster or not..... its very very clear that you really are a "NEWBIE" to the internet.
.... we have to remove all the lawyer jokes from teh internet?
... the internet.
Hmmm, maybe there really is a matrix, this internet of negativity....
... the patent systems are broken, even those who deny it but use its brokeness to their advantage.
BUT.... nobody knows how to fix it!!!
The problems lies in the "Right to Exclude"...
I know how to fix it but I've applied for a patent on it and when its granted to me I will use it to exclude any solution like it from being applied.
the wayback machine
.... and it is my conclusion that he did not come up with anything but rather this is just a way to try and establish/fabricate some legal stack of paperwork in an IP grab of something outside of the whole thing.
...and then understanding when and where this purpose is being abused, contridicted or even out of date with the changing world economy.
Here are some patent information clips from the USPTO
Note the last paragraph: "Protection of industrial property is not an end in itself: it is a means to encourage creative activity, industrialization, investment and honest trade. All this is designed to contribute to more safety and comfort, less poverty and more beauty, in the lives of men."
And consider how FOSS supports that better then what MS has been proven to contridict that, in courts around the world.
