First of all, get the Nolo Press book on trademarks. It will answer most of your questions plus a bunch you haven't thought of yet. You can get your own trademark, but if you have a pro do it, it'll cost about $1k. You do not have to sell your product to get a trademark. Sending a CD bearing the mark to someone across the country should pass for commerce.

Give me a break. No substantial meat in the article and I could care less if Steve Jobs says fuck. Slashdot editors should get off their asses and post better articles.
I went back and looked at our handbook and there are 4 separate privacy issues we addressed when we wrote it.
1) Confidentiality of employee records, background checks, and medical history.
2) Email policy
3) Drug testing and alcohol use
4) Somewhat unrelated, but still applicable is the company non-disclosure policy.

Busnesses usually have to depreciate their software over a 3 year period. If you are buying software that only lasts a year, you can write it down 100% that year. Clearly the gov gets screwed on the deal, and it could be a benefit to companies in the 38% bracket.

This is nothing new in California. A business has to pay sales tax on all tangible items regardless of where they are purchased. This is the number one moneymaker for the auditors and explains why they collect an average of $4000 per hour of audit time. This really doesn't have anything to do with the internet.
