I know this may come off a little randian, please pardon, but why can't this stuff be left to work itself out on its own? I am not so much a libertarian as I am concerned with this 'tort culture' that seems to be taking over here in the US. I think lawsuits like this are a major waste of time and money. I think these people new the deal they were gettiung into, and if they were actually valuable mindshare, they might have been hired full time from the get-go. Life is tough. But everything would have worked out OK if lawsuits like this were discouraged. consider:
If the situation were left to develop it's natural course, say by not allowing the lawsuit, there would eventually form a market around
providing temp jobs to an always hungry MS. Soon, a scarcity in temp workers might prompt a temp agency to offer benefits so as to attract the most qualified applicants, thus allowing them to charge a premium, etc. seems simple to me, and at the scale we're talking about, insurance premiums become pretty inexpensive.
As I look artound me, I see a lot of anger about corporate greed, but it is my feeling that much of bad corporate behavior is just as likely attributable to laziness. Both individual laziness and a type of interdepartmental reluctance to share credit. Any big company suffers this problem (excepts maybe those orcs over at Honeywell). But once the lawsuit started, MS was stuck: who would want to hire people that had just sued you? and so they played a stalling tactic and settled cheap. Which prevents any precedent entering the lawbooks, afaik ianal hand.
I would also like to point out that MS stopped handing out incentive shares to programmers and similar level positions many many years ago. This lawsuit was probably mostly almost definately about health insurance. I dunno though, I forgot and the nytimes is down or something right now. thanks,

dude, I live a half-block from the Pacbell station where my dsl terminates. I have the enhanced package. Here is their WEB SITE granted they aren't offering 6Mbps up anymore, they used to, and haven't cancelled our enhanced SDSL service yet. we still even have STATIC IP ADDRESSES, which PACBELL is also no longer offering. But never-the-less, and this is important, my account number with them is a PHONE NUMBER. one that you can call to and from. and the POTS access works fine with the DSL operating FULL BORE. so enough with your expertise, why don't you look up the details instead of resting your OPINION on your slight knowledge and your "last I heard"'s.
yes, it requires a dedicated line, but the POTS functionality is still present. I have awesome 6Mb SDSL, and I use the POTS for my DSS system. so I am not just assuming this stuff. maybe elsewhere in the country the have some sort of different dsl technology? different routers and switches? I think not. I have had a couple different flavors of dsl and a number of friends of mine have it as well. in every case, you can just punch in and dial on the dedicated line. try it sometime if you don't have a jack hooked up. it works.
do NOT listen to or mod UP this foolio. DSL necessitates that one simply must have a land line. You pay the $15 for a damn POTS connection as part of the basic billing. anyone with DSL CAN MAKE PHONE CALLS, and thus hook up tivos and dreamcasts all day long.
and will have all the music I'm ever going to enjoy in mp3 format. seriosly, I look around the cubes and all the guys 5-10 years older than me are still listening to Rush! $40 US for a windshield wiper blade? that's happened to me. How about mullets? why, canucks are famous the world over for that beast of a fashion statement. Trying to drive through to move to Anchorage, and they ripped apart the packed truck and took my.22 calibre rifle and my Remmington 1187 shotgun. in case I decided to stop and hunt a damn moose? F*CK!! $1200 down the drain, cause of cheap ass bastard Canadians. Can the canucks even keep up a damn road? no the AL/CAN highway is paid for by the USA. it is the only road going to Whitehorse, the only substantial city in the Yukon Territory. How about the crime and poverty of Vancouver and Toronto? for all the socialist prozletyzing, nada. Have there been any important inventions or technologies coming out of canada? name one of em. the list just goes on and on.
Why, IIRC most of the worlds oil is in the canadian gravel, the so-called surface shale, and the canucks can't even get the ball rolling to take advantage of it. Even Norway was able to harvest their oil...
