I'm no lawyer, but it seems that they can put anything in the EULA, and if you agree to it then you are bound to it. I have always seen this as an end run around the law, but it seems to be used more and more frequently.
The way that you state that you "personally own or have borrowed from friends" seems to imply that you feel that this is right, or fair use of this material.
I am no friend of the RIAA, and am strongly opposed to the DMCA, but borrowing from friends is definately stealing. I'm surprised that I only saw one post to this effect.
Has anybody given this service a try yet? Does it work?
Maybe they don't have to intercept the signal. Maybe they only have to hack into the telephone company and read their locations from their computers.
