but what's a mainframe running Linux gonna do for you?
Stability and speed. For I/O throughput, nothings going to match big iron. IBM has been cranking these things out since the 60's, and they really do know what they are doing.

A really good use would be teaching an operating systems class. Each student would get a virtual machine to play with. Easy to crash, and easy to start right back up. You get the experience of working with a 'real' machine, but not all of the headaches that come from constant reboots. I've taken an OpSys class on both the 390 and x86, and on both I had virtual machines to play with, and it was a nice change of pace to be able to crash the virtual machine rather than the real one. The mainframe had the distinct advantage of being able to host all of the comp sci classes and only start to slow down near the end of the semester. It would only start to be noticeably slow when both CPUs got up to 90% utilization. Not bad for a machine with only 16 megs of physical RAM.

So, ok, if I tape a song off the radio, and listen to my tape instead of buying a single, the artist is compensated by the radio play? No.
Yes, the artist is compensated by the radio play. The artist is not compenstated when you listen to the tape. That's why the artist is compensated when the song is played on the radio. It's called fair use. You can tape all you want for personal use. Typically, the source that you are taping from has compensated the artist for his or her work. What you are not supposed to do is make copies of things that you've fair use copied and distribute them.

Back when I had records, I used to tape them so I could listen to them on my walkman. Perfectly legal, perfectly cool. When I would make copies for my friends, not legal, not cool.

Napster does not make tapes or CDs. Napster facilitates copyright violations. Oh, according to Napster's policy, it's not supposed to happen, but it does and they know it. Spare me the struggling artist argument, Napster is used to break copyright laws. I will agree that it is not their fault, but they sure as hell can't claim ignorance. But, they are making a buck off the backs of others without compensating them, and that, according to my beliefs, not right.

Napster doesn't seem like fair use to me. For me to make a fair use copy of something, I have to copy from the original source (CD, radio, TV). Using Napster doesn't require that. Equating Napster to TDK really doesn't hold up. I can buy CDs to backup my data files on my computer. If I created the data and burn it onto a CD, there's no copyright violation. It's just a backup. If I use Napster to copy a copyrighted song, there's a copyright violation. It is possible to get songs legally using Napster, but let's not kid ourselves, the vast majority of Napster traffic is copyright violations.

  15. Re:no, No, NO! on Two-Faced Napster? · · Score: 1

movies, books, tv, or even music taped from the radio
I haven't seen too many people copy entire books.

Movies - HBO pays money to rebroadcast them. Money exchanges hands.
    TV - Same deal.
Radio - ASCAP or somebody makes sure that the creators see some cash every time the song is played on the radio.

Like it or not, Napster is making money off other peoples work. But, you say, Napster makes money off of advertising! Here's the catch -> in order to make money advertising, you have to have people view the adds. TV, HBO, and the radio broadcast things, play commericials or charge subscriptions, and eventually money makes it back to the creators of the works. They couldn't sell advertising if there was nothing to watch/listen to. Now take Napster. We're going to show adds (I'm not sure how this works, I've never seen Napster) to people while they use our software. We need to have something to draw people to us. Let's both admit that if people couldn't download good music using Napster, they wouldn't use it. You can site Napster's Copyright Policy all you want, but if people couldn't get good songs for free from Napster, they wouldn't use it. Plain and simple.

I can't recall the reference, but I think it was a Salon article that was pretty damning for the Napster guys. Some internal e-mails from those guys admitted they knew that the only way they were in business was by assisting people in breaking copyright laws.

Napster is a good idea, and the recording industry needs to wake up and embrace the idea and work with Napster rather than try to squish them. I have downloaded some free sample MP3s from various sites, found a few I liked, found a few I hated, and bought some CDs because of it.

Napster and the RIAA should strike a deal ASAP to get Napster set up basically as a radio station, where they pay a penny a transfer to the artist. That would most likey settle things, and we could get back to other stuff.

Napster is trying to make money off the works of others without compensating the producers of the works. TV stations buy programs, and sell advertising time to pay for the programs. Napster sells advertising time without compensating the producers of the works they are helping to distribute. It's a great idea, but if you are a middleman, at some point you have to pay your supplier.
