Rights that are infringed upon on a regular basis are not rights.
Look at just about any of the totalitarian countries for some vivid examples. Most of them have a constitution that protects the rights of all citizens to the same (if not greater) extent as in the US. Do you claim that those people have the same rights as you do? I certainly hope not.
I don't think you can blame a language for the mistakes stupid programmers make. The fact that JSP allowes arbitrary Java code is very convenient at times. However the companies and programmers that screw up their presentation and logic layers just because they can deserve what they get.
I have been working with JSPs Servlets and EJBs quite a bit over the past few weeks and Im quite impressed with the J2EE platform.
