However, outsiders are free to view such actions as immoral. Additionally, because there are laws against such actions, the company would be in some way punished by the external forces.
However, you can't hold the executives of a corporation as responsible to react in a way that makes the public happy about their decisions when they are staying within the law.
There is academic work into asynchronous designs. The primary obstacle (I believe) is that all the tools we have (and have been designing for 30+ years) are based on the synchronous paradigm. Plus, all the engineers Intel has know how to design and optimize synchronous circuits, but may not with asynchronous. I'm not sure what it will take for this switch to occur, because from what i've seen you do got a lot better of a processor with asynchronous, but the barrier to entry seems too high...
