The Lawful Arrest
FAQ points out that the objective proof that a crime occured is called
"corpus delicti", which requires
a victim who has injury, and
a criminal cause (as opposed to an accident, or act of god)
Now this brings up a question: What is the name of the victim? Is it
Intel Corportation? Can a corporation be a crime victim? And the nature
of the injury? Certainly a person can receive a broken arm, or loss of
life, but how exactly can a corporation be injured?
You see, corporations are defined under the law as an "Artifical Person"
for these reasons:
"persons" can own property,
"persons"
have rights,
"persons" can engage in contracts,
"persons"
can sue and be sued, and presumably
"persons" can be injured, "persons" can be
crime victims
I personally question the notion that these "artifical persons", or
"corpses" as Dave Ratcliffe
calls them, these human constructions which own most of the property in America,
which have more political clout than any natural person, which have more financial
resources than any of us, I question whether these soulless abstractions
without a moral consciousness can be considered an honorable creature (honor
is requirement to being a party to a contract). I question what it means
for a corporation to own land or TV stations, and wonder where the present
system will take us. I especially question the notion that corporations
can be injured, or can be crime victims.
The case of Randal Schwartz is extremely important, and is related to many
cases of late (mafiaboy, Emmanual Goldstein/2600, Kevin Mitnick,
Oprah Winfrey's free-speech case against the cattle industry, etc.)... all against alleged
"corporate crime victims".
If we don't protest this, soon we all will/could be accuesd of some non-crimes
like "uttering a trademarked expression without paying propery royalty, and
in a disparaging fashion leading to loss of the profit that a corporation rightly deserves"
or some such foolishness...

Sure. Ever worked a gig in the Bay Area? Freaks,
Deadheads, long-hairs, and flower children everywhere, and many working for high-tech firms,
pardon the pun;^). IBM is doing a lot of this linux work in Austin, which is a pretty hippified place...
At least that's how was. That's how it looks. Word has it that several of the
coolest stoner spots have closed (White Rabbit, Steamboat, Electric Lounge, Liberty Lunch,...) have closed up, and most of the big tech outfits
there (Moto,
AMD,,and Big Blue, all have drug tests...
Austin Comedian Steven Kendrick says that "Austin Sucks" now because of it... (Of course, you can always refuse to participate in FORCED URINATION, and help make the world a better place in the process...)
The moral of the story is that it may be hip to *look* like a hippy, but just don't *act* like a hippy...
The canonical treatise on the concentration of corporate power
in the media is Ben Bagdikian's excellent The Media Monopoly.
We need real alternatives to the corporate gerber, and one real alternative is Public Access
Television. For those that don't know what this is, it is a system
whereby the cable provider allocates channel space, and provides
studios, equipment and training to *anyone* to create their own
TV shows. A fairly complete list of these facilities is here: http://www.openchannel.se/cat/.
Educate yourself about Public Access, petition your local city government
to require it (if you don't have it), and MAKE YOUR OWN TV SHOW! (It's real fun!)
Keep in mind that for these corporate media companies to operate, they generally must obtain
the grant of a franchise from your city government. These franchise agreements have a term limit (like 10 years), and ensures a bit of local
control w/r/t taxation (franshise fee), and that the franchise operate in the public interest.
Now remember that in the USA, government is created by the people, and the government charters or franchises these media companies. A creates B and B creates C... Get it? The people ultimately sanction the corporations, and thus, they must operate in the public interest.
So, while you're petitioning your city government to provide Public Access Television, be sure to remind them that it is their duty as public servants to make
sure these monopoly franchisees operate in the public interest, like the
Terms of Use "Agreement", where YOU the user must usually
"consent" to monitoring, such that you won't engage in any sorts of illegal speech (whatever the hell that is), that you won't run servers, etc. This stuff is NOT PROPER SUBJECT MATTER for a common carrier to require in contracts with customers, especially when they are the only game in town (monopoly) AND that they are supposed to be operating in the public interest, as they were created by the government which
"derives it's just powers from the consent of the governed", to quote TJ.
Rate is exponential, and increasing, over a
large enough interval. Even the graph you refer
to expects the world pop to reach 11 B by 2200.
The only problem is, whether the rate is
increasing or not, it is undeniable that world
population is increasing. Our nasty Western
habits of meat eating increases our ecological footprint significantly, as it takes about 20 pounds of corn to produce 1 pound of beef. IF the
world switches to a vegitarian diet soon (yeah, right), then it might be possible to support that many people. Otherwise, it's gonna get real ugly.
Also, if the estimates at Jay Hanson's site are correct, guess what happens when you combine a rising pop, and a rising demand for energy, with decreasing rates of returns on fossil fuels? Sure, there will be wars and suffering in the Mid East fighting over oil, but in the long run, it will be for naught. When the oil, gas, and coal run out, suddenly, people will resort to cutting trees for fuel at rates that will make the present destruction of the rain forests look miniscule. When the trees are gone, so will follow the climate.
Can we slow down on the rutting until we figure out this whole food, air deal? --

The "capabilities" are a neat idea, but it is
the honor system. Applications need to be written
to relinquish the privs they don't need. Legacy apps will *still* have God privs...
Quite powerful. At the same time, it's also contains a certain potential danger due to making an unprivileged binary slightly privileged.
System admins take note. No longer will you
simply need to "find / -user root -perm -4000"
to locate privledged programs. Introduces a new
mechanism for hax0rz to hide things...
Then, the lawyers and other rent-seeking
non-productive leeches upon the economy
would have to pay a royalty. The more they profit from pain and misery, the more they have to pay. (Before you mod me down for trolling, please go to you library and try to find Black Hole Tariffs and

Capitalism is unsustainable, and the incredible growth of homo sapiens have enjoyed over the last 200 years (From 1 billion world population in 1800 to 6 billion today) is due to "spending" a bank account that was accumulated over billions of years: fossil fuels (source Thom Hartmann: The Last Hours of Ancient Sunlight). We have reached the maximum rate of extraction, and this rate will begin to decline, while demand and human population continues to grow *expontentially* (source:
Jay Hanson)
If by "capital" you mean money, then follow some of these links to
The Creature From Jekyll Island
By G. Edward Griffin: Money is not wealth, it is debt, perpetual debt, which can never be repaid (because the interest/usary is not created whithin the system), and thus always leads to bankruptcy, forclosure, "reposessions", sherrif's sale, and military actions, which the author calls modern Alchemy, since this is how the lead bullets of war are converted into gold.
Capitalism supports slavery. Capitalism encourages unsustainable population growth, depletion of natural resources, and the creation of waste products. "Property Rights" are paradoxical, since the enjoyment of this right must deny this very same "right" to another.
Isn't it time we figure out a different economic system that is sustainable, and less violent?
Ob Bill Hicks Quote on Economy:
I'm glad that psilocybin mushrooms are illegal. Because when I took them,
I laid in a field of green grass, thinking "I love everything!" I realized
that our true nature is spirit, and that it is only illusion that we
are apart from God, and that God loves us. So, can you imagine what
would happen if everybody started experiencing Universal Love? I mean,
how are we gonna keep building Nuclear Weapons when we realize that we
are all one? It'd fuck up the economy! --

Wrong. Legally, a crime must have a violation of statute prohibiting certain conduct and establishing a penalty.
Thanks for summarizing the prevailing view of
tyrrany^H^H^H^H^H^H^Hthe law in the US.
I don't agree with everything in the Lawful Arrest FAQ, but it makes some interesting arguments. Like, if crime is not defined in terms of victims and injury, but instead is defined as a "violation of the law", it is paradoxial and self-referential!
Crime is a violation of the law
The law is that which is crime
Huh? This is the "Begging the question" fallacy. It's an infinite loop. Put these in your computer programs and they will generate heat, but do little else;^)
So if distributing "harmful matter" (what
Jello Biafra was accused of)
is criminal, or if distribiting DeCSS or other "infringing speech"
is criminal, AND if creating a link to such a site is equivalent
to the "crime" itself, what will become of search engines?
So, soon all the search engines will universally adopt the
list of banned sites from BESS,
Netnanny, etc., and then
the net will be truly safe for children! Nothing
controversial, no illegal speech, no forbidden speech,
and we will all be using our cable modems to download
live streams of Barney and
Teletubbies...
Being a volunteer producer for

Cause of Action requires:

Look, no one is denying that forcing a child
to pose for nude photos (or worse) is a crime.
And let's say some sicko scans them and posts them
to Usenet. And let's say that Fred O. Phile likes
to look at such pictures for erotic pleasure and downloads them from his ISP.
Ok, Fred is a pervert. But did he produce an injury to the child? No. The ISP is in the business of passing bits around. Did anyone
at the ISP cause an injury to a child? No.
I'm going to go out on a limb here and assert that not every photo of a nude child actually
produces an injury! BUT: if there was an
injury produced, perhaps it was the guy that
took the photo, and NOT the ISP, and not the
guy that pulled it from a.b.p.k-p

WEB BUILDERS: Tired of hacks and versioning? Write valid markup...
Hey, that's not a bad idea. I can't tell you how many times I find images w/o ALT tags, which are quite important for text browsers and for those that are visually impared. AND, the validator dings all those &%$#@ Microsloth "smart quotes",
which render as ?question marks? w/Netscape on Unix. The aptly named Demoroniser can help you fix these...
But to suggest the we NEED to use wizzbang doodads like javascript, CSS, etc., and we need to force users to enable these things is ridiculous! Personally, I don't trust java and especially javascript, and try to run with them
turned off. I can't stand it when web designers
force me to enable these things, when mostly it adds nothing to the content or the useability.
Since I actually *want* people to view my pages, so I usually try to code for a maximal audience.

According to Leadbeater the "first Internet" failed because the technologists and geeks,
Failed? It was awesome!
I was just talking to a guy on the train about this last week. I was
reminiscing about the high-signal-to-noise days of the early days of Usenet over the
Arpanet (late 1980's). He was yacking on about some new startup making pay-as-you-go chips that was gonna be the next e-boom,.... yeah yeah yeah.
He was telling me that I should "load up" on this stock and
that I would be rich.
I was telling this guy that I thought e-commerce was a big
capitalist gang-bang, and that it (and advertising) has ruined
then internet. And reminded him that the Internet was originally
a SOCIALIST program, meaning, government "controlled", funded with
tax dollars... and it worked real well!
I couldn't belive that I was saying this, as I'm a
Green/Libertarian, and the term "socialism" is anathema to the Libs,
(as well as the Dems and the Repubs).
But think about it: Certain things SHOULD be funded by a socialist model.
The roads, for example. In a "free market" system, you'd have 2 toll roads
going between the same 2 points, with the toll takes competing/colluding
for your money. Look at the Cali energy crisis: public utilities should
be severely regulated!
Look at the capitalist/commercial media in America. It sucks. It does
not inform, it does not provide a balanced view of things, the
corporations control the elections... the capitalist media does nothing
well, but produce/distribute SPAM.
The socialst media in Canada and England
produce some wonderful art (Imagine Monty Python or The Young Ones being
produced in America?). The only thing like it in America is
Public Access TV, or community radio (like what
Pacifica is/was/tries to be)
which has a socialist funding model with a
decentralized authority (just like DNS).
I say its time for a return to the Socialst (economic) internet model, with
the goals of decentralization and free speech, get the profit-seekers
off the 'net, and immediately delcare the
Deja archive
a national treasure, with the goal of an UNCENSORED archive
being restored/preserved for the good of mankind.
Troll or not, it's scary stuff...

Saying "Ted Kaczynski, the Unibomber", as

is to show journalistic BIAS.
Let's not forget that the FBI called paper clips found in his

were saying, "Yes, poor Ted IS guilty, but it's OK 'cause he's

There is plenty of evidence to show that Ted was railroaded.
The message in Ted's case is that any intellectual

must be a killer. Anyone who writes anti-capatilist literature is a terrorist.
Just like in the OKC thing. If you oppose what happened in Waco, you are guilty of OKC bombings.

Ok, Fred is a pervert. But did he produce an injury to the child? No. The ISP is in the business of passing bits around. Did anyone at the ISP cause an injury to a child? No.
I'm going to go out on a limb here and assert that not every photo of a nude child actually produces an injury! BUT: if there was an injury produced, perhaps it was the guy that took the photo, and NOT the ISP, and not the guy that pulled it from a.b.p.k-p
Hey, that's not a bad idea. I can't tell you how many times I find images w/o ALT tags, which are quite important for text browsers and for those that are visually impared. AND, the validator dings all those &%$#@ Microsloth "smart quotes", which render as ?question marks? w/Netscape on Unix. The aptly named Demoroniser can help you fix these...
But to suggest the we NEED to use wizzbang doodads like javascript, CSS, etc., and we need to force users to enable these things is ridiculous! Personally, I don't trust java and especially javascript, and try to run with them turned off. I can't stand it when web designers force me to enable these things, when mostly it adds nothing to the content or the useability.
Since I actually *want* people to view my pages, so I usually try to code for a maximal audience.

Besides, it's all just an attempt by the Feds to get you to switch to these new browsers with enhanced snoop capabilities. Haven't you read Jim Redden's Snitch Culture?

NO SEARCH ENGINE I've ever seen, web or news, had the rich regular expressions that Deja had... I doubt that google will allow things like:
(pot|mj|hemp|ganga|bhang) & (prohibition|legalize)
The Deja archive/interface is a national treasure, and the National Guard should be called out to preserve it from all profit-seeking devils!
According to Leadbeater the "first Internet" failed because the technologists and geeks,
.... yeah yeah yeah.
He was telling me that I should "load up" on this stock and
that I would be rich.
... ;^)
Failed? It was awesome!
I was just talking to a guy on the train about this last week. I was reminiscing about the high-signal-to-noise days of the early days of Usenet over the Arpanet (late 1980's). He was yacking on about some new startup making pay-as-you-go chips that was gonna be the next e-boom,
I was telling this guy that I thought e-commerce was a big capitalist gang-bang, and that it (and advertising) has ruined then internet. And reminded him that the Internet was originally a SOCIALIST program, meaning, government "controlled", funded with tax dollars... and it worked real well!
I couldn't belive that I was saying this, as I'm a Green/Libertarian, and the term "socialism" is anathema to the Libs, (as well as the Dems and the Repubs).
But think about it: Certain things SHOULD be funded by a socialist model. The roads, for example. In a "free market" system, you'd have 2 toll roads going between the same 2 points, with the toll takes competing/colluding for your money. Look at the Cali energy crisis: public utilities should be severely regulated!
Look at the capitalist/commercial media in America. It sucks. It does not inform, it does not provide a balanced view of things, the corporations control the elections... the capitalist media does nothing well, but produce/distribute SPAM.
The socialst media in Canada and England produce some wonderful art (Imagine Monty Python or The Young Ones being produced in America?). The only thing like it in America is Public Access TV, or community radio (like what Pacifica is/was/tries to be) which has a socialist funding model with a decentralized authority (just like DNS).
I say its time for a return to the Socialst (economic) internet model, with the goals of decentralization and free speech, get the profit-seekers off the 'net, and immediately delcare the Deja archive a national treasure, with the goal of an UNCENSORED archive being restored/preserved for the good of mankind.
Call me a dreamer
Hey, I'm down on how Western Medicine is about Profits over healing as much as the next guy, but there are bigger issues here...
There is NO correlation between the so-called HIV virus and the AIDS syndrome... Don't they teach the Scientific Method in medical school anymore?

Saying "Ted Kaczynski, the Unibomber", as Katz does (and not something like "Ted Kaczynski, the man convicted for the Unibomber bombings" is to show journalistic BIAS.
Let's not forget that the FBI called paper clips found in his home "bomb making equipment" (and not "letter writting equipment"). Let's not forget that while his court-appointed lawyers were saying, "Yes, poor Ted IS guilty, but it's OK 'cause he's insane!!!, as Ted was trying to fire the bastards and plead innocent, but NOO! the judge says... Ted isn't competent to speak for yourself in court.... You CAN'T plead innocent. Shut up and sit there and take what you got coming.
There is plenty of evidence to show that Ted was railroaded. The message in Ted's case is that any intellectual that abandons technology and moves to the mountians must be a killer. Anyone who writes anti-capatilist literature is a terrorist.
Just like in the OKC thing. If you oppose what happened in Waco, you are guilty of OKC bombings.
Where's the critical thinking? Where is the skeptical inquiry?
