    Hrm. If you are adult enough to be responsible for your actions when you are 12 years old, why hasn't the drinking or driving age been lowered to 12? Voting? Sexual consent? If you are going to hold a 12 year old to adult standards, they should also get the benefits of being an adult. Otherwise, the laws are hypocritical.

    a) There is no EULA on a DVD.
    b) EULAs are not binding contracts, anyway.
    c) Buying the disk explicitly gives me the right to view the contents of the disk.

    I'm thinking of running out and buying 20-30 tivo units. Then I'll wait for a hack that allows the use of alternate guides. Once that happens, I will incorporate both hacks into the boxes I bought and sell them at a $100 markup.

    Anyone think this is a good idea? Should I buy now, before they alter the hardware so that I can't?

    Hack it all!

    Cut the Tivo software out of the thing completely if it comes to that. Get your program listings from tvguide.com.

    Umm, once the program guide is hacked, there would be no need for anyone to connect to the Tivo service at all. There would be no way they could 'upgrade' the software to do anything at that point.

    Isn't space-shifting protected as well as time-shifting? Isn't this just a convenient way for people to copy a few episodes of "The Simpsons" to CD-R?

    Why is it that people forget that EULAs are not binding in any state except for Virginia? It doesn't matter if he clicked the thing 100 times, he is not bound by anything that it stated.

    When the company starts uploading restrictive software to your hardware without your permission, I think it's time to start figuring out a way to remove their 'services' from your box. If they would have left well enough alone, I would agree that the boxes shouldn't be hacked to remove the subscription. As it is, fuck 'em.

    Funny you should mention Orbital. I just, five minutes ago, gave them some money through fairtunes because I downloaded their new album and liked it. I figure I just made up for about 10 people who will download it and not pay.

    Nobody should have a problem paying for music that you actually enjoy.

    Algorithms/Designs are not physical objects. They are instructions for doing something. Your computer is the physical object.

    Should my recipe for chocolate-chip cookies be patentable? Of course not. Neither should any other algorithm.

    Code is not a machine. It is not a physical product at all. A CPU *is* a physical product, and is subject to patenting. If I can make a program that is able to read or write your codec without using any of your code, there should be no restrictions against it. Patenting a codec is like patenting water because you made a new water pump.

    Companies that *make* software won't like open source. Companies that *use* software won't care whether their software is open-source or not (except for the fact that they don't have to pay Microsoft's ridiculous license fees).

    How do you figure?

    Nobody can trace who inserted a particular file, and there is no way you can be forced to remove something once it's there. Even if someone requests a file directly from your node, their request could be the only reason it exists on your pc.

    Where is the business plan for paying the artists anything for their hard work, not to mention all of the production staff, ad agencys, etc.
    I don't listen to mainstream music at all. I listen to techno, primarily. I support the people that i like by seeing them when they come to my town, and buying their cds directly from them while they are here. P2P applications are a perfect way for me to listen to hundreds of djs and producers and discover which ones I like. Every artist whose music I listen to does not deserve my money.

    Okay then. Fire up Napster or Aimster, and search for a High Quality JPEG reproduction of the Mona Lisa. How about a file which describes the inner workings of a Floppy drive? Or perhaps the entire text of 'Macbeth'?
    Funny, I just searched gnutella for the three of those and was successful at getting two of them. Floppy drive manuals must be hard to come by. Sure, I did find about 5000 copies of songs by N*Sync too, but the data available through these networks is more extensive than you think.

    Just stop buying cds - period. I haven't spent money on a new cd in 2.5 years. Right now, you can get a cd-r for $50 (www.pricewatch.com) and a 50 pack of media for $8.99. Why would anyone pay for a cd ever again?
