People are bad enough drivers in 2 dimensions; I don't want to have to deal with them in 3 dimension as well and I don't want flying cars falling on my house either.
First you say that such agreement sideline a lot of talent, then you say we need to limit what kind of restrictions companies can place on their employers.
Seems to me that potential employees are already doing that through a little thing called freedom of association. I really, really do not want the government dictating the terms of my contract/employment/enslavement or whatever agreement I happen to enter in to. The government is there to adjudicate a dispute in the contract should one arise, not set the terms for it to begin with.
About eight years ago I got fired from my jobs as Unix admin.
The bastards fired me and I stayed for five weeks until I found another job, gave two weeks notice and trained my boss for my job.
The worst part of it is, they called me back about a year and a half later because they were firing the admin who replaced me and they didn't know how to lock him out of the system. Oh the humanity!
Using unlicensed software is not stealing simply because you have not deprived anyone of using their property. It is an infraction (a civil violation) but that's a different issue. IANAL
Let's stop calling it STEALING.
Speeding is the perfect analogy for this. Speeding is not a crime unless you go over a certain limit. Likewise, using unlicensed software is not a crime unless you go to far (selling fake copies for example).
If using unlicensed software was a crime, Microsoft would have had a lot of people in jail by now.
