Why shouldn't industrial design be a factor in purchasing a computer? People want to feel comfortable when they're using a computer, and having it look nice is one way of achieving this. Another way is having a consistent interface, another thing which Apple is known for.
People are saying that because they may have pirated (ooh there's that word again) the beta, then they do not have to follow the terms of the licence and/or NDA.
What if someone else gave me a copy of Emacs without the GPL mentioned anywhere, could I distribute it in any form I wish?

Actually, that is wrong. If the sample is recognizable, and forms a "significant part" of the derived work, it is infringement.
