The way it works doesn't really surprise me, municipalities take this amazing technology, apply bad practices, lowest common denominator stuff, and use horrendous security at an inflated cost for not much benefit.
My position is that it's a farce in the first place and that was just a symptom.

Yes, I forgot that if they are able to install software on your computer, they might also be able to install a root certificate created by the police, and send you a kind-of-genuine certificate for www.terrorists.com, signed by www.police.de. Or they _might_ be able to convince a certificate authority to give them an actual, valid certificate for www.terrorists.com, which would be a bit worrying.
If they DNS spoof and redirect traffic to one of their servers, and have a valid certificate for "whateversite.com" issued by Verisign, you'd get no warning at all. I doubt this would even have to be at the physical layer.
Yeah, the signal to noise ratio would be through the roof if you just scan everyone.

Your ISP's server could also do a zone transfer from a rogue DNS server and get poisoned cache. But most smart ISPs won't allow that.
What's going to stop a worm from using the vulnerability MS opens for a whitehat worm for nefarious purposes? It will be found.
