A "Lindows" trade mark cannot infringe on one for "Windows". The issue is that, by presenting itself in the colours used on the website and marketing materials that they could be "passing off" their product as Windows and gaining positive PR and goodwill from the Windows trademark.
As they are marketing as an alternative - and publicly noting that this is an alternative - then really this allegation has little substance.
The only possible issue is that their proposed UI smacks of Luna - or that's what the website theme would suggest. Until we see the worded court documents then this is all conjecture.

True. They hired Jordan Hubbard and made sure he could pay the rent. They hired Bud Tribble and Brian Croll who were both Eazel developers. All these guys have to pay the rent.
There was also that NFStest stuff that Avi gave to the BSD guys which they are using to "fix" NFS which is pretty borken!
I don't think they care about getting into "good books" any more than providing a machine that works. No-one is saying dump Linux, they are saying that when using screen and mutt, use a Mac OS X Terminal window...
At the end of the day, there are two operating systems in the world. Those that are UNIX(like) and those that are just Windows. To me that speaks of opportunities especially for you Linux guys who have excellent knowledge of your systems. Brush up a bit on Darwin and become a Mac OS (X) systems expert. The end users themselves can do the GUI stuff but they may, at some point, need someone to have a look at the plumbing. Hey, if ya make a quick buck then all the better.

We used to be 30% Mac and 70% UNIX. Now we're 100% PC due to some questionable decisions about four years ago. We've lost more "features" than I care to count, we don't seem to have better security due to weekly updates because of security exploits on Windows and at least when my old Mac crashed I could get someone to fix it and the problem would go away. These days the spotty IT geeks just say "Reboot and ignore the error messages".
Sure, our machines are faster now but I'm comparing a 800Mhz Pentium with half a Gig of RAM to a Quadra 650 (at what, 40Mhz) with 16 Mb RAM. If it wasn't faster I'd be wondering. Windows has been such fun that I went out and bought a Powerbook for myself.
If I were a programmer I'd certainly step up to the mark. I'd aim for a Cocoa application - certainly not the "single window/desktop" mess that StarOffice seems to be.
As it is I've thought about things like this a lot. I'm working on starting up my own consultancy/training business. My aim is essentially to have a small team of consultants and trainers and have two programmers for conultancy work. 50% of their job will be to do what we call our business. 25% will be to surf the web and troll on/. The remaining time will be to contribute to things like the OSX port of OpenOffice...
I think it's important to contractually oblige people to surf the internet and troll around on/.

Using strict biological terms "fitness" can mean just about anything.
Making sure your maize or tomato crop isn't damaged by weather or can recover from being trodden-upon or even ensuring that a higher percentage of the seeds sewn actually germinate is separate from protecting the plants from pests, fungi and weeds.
They should be Gm'ing the plant to be stronger, fitter, more productive and have better shelf life. They should use other organic methods of protecting the crop from pests, fungi and weeds - they can GM a lot of bugs this way.
The problems is that they currently GM corn etc to be pesticide- and herbicide-resistant so they can dose the crop with more chemicals to kill more weeds and pests. Problem is that we then end up eating the crop that is saturated literally with poison. It's bad enough for veggies but meat products concentrate it even further!
But, shit, I can't do without my steak and tatties.
Apple has some of their own home-grown codecs. But they want to support the standard.
