Oh, get a grip you little baby. I was pointing out how horrible the grammar was in that journal entry. The guy was advertising that journal entry in his sig; he could at least run a spell checker and grammar checker.
Is your time that unimportant that you need to defend poorly written journal entries?
So no, killing someone for any reason is not murder, as much as your logic-less mind would like it to be.
Bzzzt, sorry champ, I have more logic than you can understand. I will try to keep this simple for you so as not to go over your head. You come to my area, I don't like you, I plan to kill you (but want to get away with it), I get drunk, I get in car, I find you, I run your over or slam into you, you die, I get slap on wrist since I did not INTEND to kill you, I get away with a _very_ small penalty for killing you, good legal system, do what one wants, no penalty, just say you didn't INTEND to do it, no problem.
Oh, come on now. Do you think that the Yankee Group works for Free or do they work for the "good of man kind"? No, someone _pays_ them. The Yankee group doesn't want to see that undermined so they are reacting with more FUD.
MS has comes out with more anti-Linux FUD than the other way around. Do you remember the "get the facts" efforts of MS? Do you remember the file/print server "tests" MS "sponsored" with Win2k3 against the latest Samba? MS built the best Win2k3 server they could and then pick the worst Linux server they could with software raid. Linux is usually good with software raid except for a certain type of software raid. Guess what type of raid MS "picked" to do their test on? Yup, the type of software raid where Linux was not at its best.
When far more even test were done that picked the best for Win2k3 _and_ Linux/Samba, the Linux/Samba combination was _always_ faster and more stable. That is nothing for MS to be ashamed of. The Linux/Samba combination just happens to be better. MS Window servers do have their strengths, such as Active Directory. While as a programmer I hate AD for being such a non-standard LDAP, AD does have some nice features over standard LDAP for admins. It is just too bad MS doesn't release all their specs ; (
I am not a huge basher of MS products (though I am a basher of the MS company and the way MS is ran). I have programmed and used both products extensively and Linux is a freaking _great_ server. Win2k3 can also be freaking _great_ server as well. I personally switched from Java to C#. I LOVE C#! I use it under WinXP, Win2k3 and Linux/Mono. I personally think both OSes have much to offer. Both have faults and both have strengths. It just gets silly to see MS constantly try to spread FUD about Linux and how it is "not ready" and other crap. I just want to see MS compete. You know, the good ole capitalist way. I will continue to use both Linux and MS Windows as long as both of them meet my needs.
However, I must admit that I am personally in a non-standard position. I am a senior programmer for a fortune 500 and they spend a couple grand per year to buy me a Universal MSDN subscription. That gives me access to most of the major MS software. If I didn't have that access, my only real option would be OSS based around Linux because of the extreme cost of development under MS Windows. Sure the costs under MS Window is not much to a corp., however it really adds up for a home user/programmer. Again, I wish all this FUD crap would just stop from _both_ sides. However, MS has a lot of money to lose if they let up, so I don't think we will be seeing MS trying to compete any time soon. Sadly, MS will use anything they can to continue their monopoly on the desktop and all the FUD they can to try to get a monopoly on the server.
However, I am sure that the money still had other measures to prevent fakes. The paper for _all_ US currency has been made by the same company for ages (I just some something about this on Discovery). The company keeps most of its methods secret for a reason, they also had some very heavily armed guards at different parts of the facility. So even if there wasn't a security bar, the paper would have had other properties that make a fake easy to detect like watermarks, discolored paper with a special marker, glowing under ultra-violet light, and others. Though obviously the most modern advancement of paper money is the security bar which happens to be the easiest to detect. It is not too hard to detect a fake of US currency if you just hold it up to light. The paper that is used is just incredible with all the properties it has. Though sadly, when was the last time you watch a minimum wage cashier hold up your $1, $5, $10 or even $20 dollar bill for inspection? Those denomination happen to be the most counterfeited bills in circulation.
Funny, I grew up in NJ until I was 13 then I moved across the "Trenton Makes the World Takes" bridge to Yardley, PA. I lived in Yardley, PA until about 5 years ago (I am now 32) when I met my wife who is from Cherry Hill, NJ. We got married and moved down here to Orlando, FL. I do miss NJ and PA. Although I don't recall the signs you are talking about, I _do_ remember seeing tons of cops in NJ and PA who would pull your @ss over in a heart-beat. Down here in Orlando, FL I _never_ see cops or state troopers going to work. People can go 95 MPH on a 60 MPH road and just don't have to worry about tickets. While I don't miss the cold and snow, I do miss the tough-@ss cops of NJ and PA. I wish we had them down here to smack around some of these idiot drivers.
Oh, come on. All the cop or the idiot cashier had to do was hold the $2 bill up to light. They would have seen the "security bar" in the paper along with a bunch of other security measures that the US treasury puts in all printed money. I am sure that all "Best Buy" stores have at least _one_ of those fake currency markers that they could have used. Just draw a small line on the $2 bill, if it didn't turn the correct color/colour, it is a fake.
While I am not a sue-happy person, I hope this guy gets millions from "best buy", and even the "police force". Citizens should not be expected to put up these kinds of actions. Cops should be required to _always_ assume that a US citizen is innocent, and not assume guilt as has become the norm in our $uck up nation!
Cops don't need a warrant to respond to a complaint.
No, cops do not need a warrant to just respond. However cops do need more than just one witnesses hearsay to make an arrest. Cops need a little more proof to arrest someone. Imagine if cops could go out and arrest someone on just one witness. I call the cops and tell them I just saw fm6 smoking pot, go and arrest him/her. I later call the cops and say I just saw fm6 speeding, go and arrest him/her. A little later, I call the cops and tell them that fm6 just stole $1,000 from me, go and arrest him/her., etc, etc.
Do you see where I am going. Cops could never be allowed to arrest someone just on one persons story. If they could, the road would be a much better place to drive. Heck, I would call the cops on any one that I thought was driving reckless and get them arrested.
There was actually a time when my wife was out driving in the new min-van I bought here with our first new born child. She was driving _really_ cautiously. Some @ss cuts her off. She calls me frantically and tells me she is going to call the cops and hangs up on me. I wanted to tell here it would do no good, however she didn't even give me the chance. She called the cops and gave them the license plate number of the @ss and told the cops what happened. The cops told her there was nothing they could do since the act was not committed in the presence of an officer.
I would be really scared if cops in the USA were allowed to just arrest people on just the "testimony" of one person. Please don't tell me this has happened any where!
Huh? So if I kill you with my car because I was piss drunk it is not murder? If I run you over while I am trying to get away from another crime I committed, it is not murder? Man, you have some serious issues! Killing a person against thier will for _any_ reason is MURDER!
Is there _anyone_ that you actually love in life? A wife/husband, child or family member? If so, pretend I killed them when I was driving down the road piss drunk. Would you stand up in court and fight for me so that I didn't get a big sentence because I didn't "murder" your loved one? I am glad I am not related to you. You obviously have no heart or love for life in you.
Oh, and before anyone attacks me as a flamebait, I was being somewhat faceitious. That bill went a little overboard when it proposed death by hanging for someone that commits 3 misdemeanors! Three parking tickets and it is time to pull out the noose : )
How about just kill them with your car? In New York, you can get away with 0 - 16 months. Google is your friend. I just search for "average vehicular manslaughter sentence".
Here is a good bill proposed in 1999 to deal with criminals. Well maybe it is a just a little too extreme, but most of it I think is right-on-the-money. Make sure you read the whole thing, it is not that long ; )
That is "first degree murder". There are plenty of ways to kill a person and not get "first degree murder". Read my post about two such cases. Heck, the easiest way is to just get drunk and get in a car and slam into some one. You will probably just get "vehicular manslaughter" or something with a much, much lower sentence.
A single instance of premeditated homicide affects perhaps a few dozen people.
Then:
A single instance of spamming affects perhaps millions of people.
Then:
I am opposed to the death penalty for all crimes
Umm, so why exactly are you opposed to the death penalty? It clearly sound as if you think financial damage is "much, much higher" than the value of life. From your post is sounds as if you think that if I cause 1 Billion in damage to a corp that it would be a greater crime than if I killed just one person. You know, I keep telling my self that people like you really don't exist in the world, that most people are decent. However, reading what your wrote behind your AC shield, is making me start to doubt that most people are decent.
No one ever gets SENTANCED to 2 to 3 years for murder.
Sure they do. Down here in Sunny Florida, I have heard of two examples. 1. A drunk driver killed an innocent driver. The drunk guy got "involuntary manslaughter". I guess getting trashed and driving is "involuntary". 2. There were these two girls (I think 18+, but still young) that shoplifted some bathing suits. They ran out to their car and the security guard tried to get them to stop. They just ran the poor guy over and killed him! At trial the "brilliant" judge ruled that the girls could not be tried for murder since the killing was not done during the act of a felony, but a misdemeanor shoplifting crime! The girls as most will be tried for "negligent homicide" or some really low crime that will probably give them both a few months in jail with probation. SICK, SICK WORLD!
The judicial system - all judicial systems - are based more on business cost than morality, and with good reason: morality is ambigious and dynamic, dollar values less so.
Are you trolling or being facetious? I hope facetious. If not, do you really think that money is more important than human life? If I kill a hobo on the street, I get a slap on the wrist since there was no money lost. However, if I kill a billionaire CEO, I get life since I lost a lot of money for a very rich man?
This spammer is going to jail because he worked as an idividual. The only thing spammers need to do is set up a corporation and do all their spamming behind the corporate sheild. MS doesn't go to jail for the crap they pull.
This "law" will not stop spamming. All it will do is move the spammers out of the USA or cause them to set up "corporations". This way the spammers behind it all can get away with the same things corps can get away with and the only punishment will be fines.
MS, Oracle and BEA send me tons of crap spam. Though I will admit that there is a difference because the big corp spammers are smart enough to not spoof an email address and honour opting out. Seriously though, if I was a spammer, I would just set up a corp and use a valid email to send out "targeted marketing" with valid opt-out. Problem solved for spammers. They no longer have to worry about this "law". Oh, and the smart spammers will just make their opt-out a "per-account" opt-out scheme. Meaning that for each different "targeted ad" they require you to opt out. So if you opt out of their "Penis enlarger" account, you still will not be opted out of the "breast enlarger" account or the "XXX" account and so on.
That is _the_ dumbest analogy I have ever read on/.
When I buy a car, I do not have to agree to some encrusted EULA about my usage of that car. If I don't like the rims I can take them off and I can buys rims from some company I like. When I buy a car, I don't have to agree to some encrusted EULA that states that I am not allowed to resell that car. I can take parts out of that car and sell them or put other parts in. MS doesn't let you replace all the software that comes with the OS, not even most of it. To agree to the MS EULA, you give MS permission to control certain parts/aspects of your OS. Nissan doesn't have any control over my car after I made the purchase. I can go on and on here.
The point is, is that the MS EULA says you are entitled to a refund if you do not agree to the EULA. So it is OK for MS to not live up to their end of the EULA why end-users are supposed to uphold their end of the EULA?
Why do you have a tinyurl link to your/. journal? If you want to make an effective point, I think you should invest in a spell checker and certainly a grammar checker.
From your sig/journal:
Only about 1000 people were killed in those 5 years and that was considered a lot.
Only 1,000 and it was "considered" a lot? Which is it? Only 1,000 or a lot?
AI and other so called human rights grousp stepped in and pressured the Socialists to stop the offensive an have cese fire
What did AI "step" in? Doggy poo? Cat Poo? What is a "cese fire"?
There was a second attempt at a ceasefile last year
What is a "ceasefile"? It sounds like a bunch of lawyers charging you down with tons of documents. As a former U.S.M.C, I can handle being charged down with a weapon, just please don't send a bunch of lawyers after me with a "ceasefile"!
As of today the death toll approaches 10,000.
What day is "today"? Monday? Montag? Lunes? Please explain!
None of this would have happened had a bunch of aging hippies not stepped in.
What in the world did the "aging hippies" step in that caused "all of this"? Please tell me so I can send this information around the world to all "aging hippies" to make sure that none of them ever step in [UNKNOWN] again.
In the end the people that are getting killed are not the aging hippes or anyone they knew
So "this" all ended? None of the "aging hippes" or people they "knew" died? Well at least it all ended!
How do I know? The industry has spoken and the industry chose Apple's product instead.
The "industry" picked the Apple iPOD because it is a very nice looking device. It doesn't haven any more capabilities than most of the competition. The "industry" did not pick Apple's restrictive DRM. The "industry" or better the consumers, do _not_ have a choice with the iPOD on what store to purchase from.
I tell you what. Why don't we get Apple to do a little experiment? Apple can have their iTMS offer every song in either their restrictive DRM encrusted AAC format, or a non-DRM'ed MP3. See what format sells more. That would be the industry "speaking".
People _want_ to be entertained. They want to hear music, they want to see movies. If I made a great movie but only offered it under _very_ restrictive formats, there would still be a lot of people who buy it. Not because they "support" or "accept" my restrictive format, but because they wanted to see a very good movie and be entertained. I will bet any amount of money that if I also offered my great movie under a non-restricted, non-encumbered format, that the non-restricted format would dominate sales.
I am not a Rep. or Dem. so I am not showing bias here. However, do you have any valid links to _real_ evidence to your statments? No, Left leaning sites don't count.
The majority of paid programmer get paid by a company that does not sell software. There will always be jobs for programmers like me. I work for a fortune 500 that has nothing to do with the Tech industry and has never sold one line of code. I get paid to develop in-house applications that are for use only by the company. Even if all commercial software went away and it all became GPL'ed/LGPL'ed, there will be plenty of jobs for programmers to work for companies making custom software to help companies to perform their day-to-day business.
There is no "evaluation" version with a 30 timer that starts to nag you. You can download RHEL and make and distribute your own version such as Whitebox Linux. The only real restriction is that you cannot call it Red Hat Linux since that is a trademark of Red Hat. The main thing you get with RHEL is the enterprise grade support. If you called Red Hat and asked for support for Whitebox Linux, you would be told to go jump in a lake or something. Here is the source to RHEL 3. Go have a ball!
That is not the case at all for me, maybe it is for you though. An example, I recently purchased a Disney DVD for my daughter. My daughter got a hold of the DVD when I wasn't looking and there is now a scratch on it the prevents the full movie from playing. So my only choice is to go and buy another DVD. Since then I back up all media I buy and I will continue to do so until the media become more durable.
The other reason I back up is to be able to watch movies on my terms. For example, another Disney DVD I purchased for my daughter _requires_ you to watch stupid commercials. Hitting the menu button just gives you a "sorry chump" message. So when I was backing up the DVD, I removed all the commercials and DRM crap so now when I put in the DVD, I can actually watch the thing without sitting through 5 minutes of commercials.
I think you are looking at it wrong. If I took a song/movie/album that I had no rights to and sold it as my work _for_ profit, then yes, the RIAA/MPAA would have a very valid case/point. Now if I took a CD I PURCHASED and ripped it to OGG/MP3 for safe keeping, than IMO the MPAA/RIAA have no case/point. However the RIAA/MPAA _are_ trying to prevent me/you from being able to just backup content I/you legally purchased. I have no problem with the MPAA/RIAA trying to prevent people from doing massive uploading. However, the hole MPAA/RIAA argument doesn't even compare to this issue.
PearPC is an OPEN product that you can get for free/libre as well as Free/Speech. I can go get the code from PearPC right now and distribute it, change it, etc. There are very little rules wrt the PearPC code. The main rule is that if you modify any of the PearPC code, that new code also must be under the same license. These CherryOS guys are flippin their middle finger at that.
The only way your MPAA/RIAA argument would be even close would be if the MPAA/RIAA allowed free distribution of _all_ their content and had only the requirement that if someone modified their content, that new content would be covered by the same license. Please, shoot me an email the day the MPAA/RIAA make that policy change!
