When did they not allow you to trademark simple words? Might come as a surprise to companies like Apple, Catepillar, Dell, Ford, Hallmark, etc. You are quite correct on the other part. Trademarks only apply to the industry they are registered in.

I stand by my original statement. Mac users are ferverently loyal to Apple. They are not going to switch just because there is a new version of PC software that has features promised in a soon to be release Mac software. On the hardware side, I assume you are referring to a specific example but I am unaware of the product you are talking about. I also think that iPod is a good example of a superior product overcoming the first to market players. Actually, in the computer world first to market is often not the one to suceed. Google was not the first search engine. Excel was not the first spreadsheet app.

Not only that but you cannot be subpoenaed in a case against you anyway. A subpoena by nature is a court order to testify and thanks to the Fifth Amendment you cannot be compelled to testify against yourself.

Is that really such an issue for them? I don't remember that happening in the past and with the recent exception of the iPod I don't think there is much of a crossover between Apple and Microsoft users. Using Asteroid sounds like you would need a Mac and would a Mac user go out and buy a PC just to get a first to market alternative?

I am the last person to defend Apple but this is such a non-story. They are not suing these sites. They obviously caught somebody who signed an NDA leaking information and are suing them. These sites are receiving subpoenas because they may be able to verify the identity of said person.

  6. Re:Yes, Playboy is porn. on ICANN Approves Two More Top-Level Domains · · Score: 1

You are just adding another layer on top of the definition but still not clearly defining the break points. Pornography is defined as the depiction of erotic behavior intended to cause sexual excitement. Is a naked woman in a nudist magazine then pornography? That is hardly erotic and it isn't intended to sexually arouse (even if it might for some). And why does a "beaver shot" automatically make something hardcore? My point is not to keep breaking things down into separate categories but just to point out that it is not something easily classified. Having been to nude beache and finding Playboy incredibly boring I have a much higher threshold for what I consider sexually arousing (and therefore porn) than someone like Tipper Gore.

  7. Re:still no .xxx ? on ICANN Approves Two More Top-Level Domains · · Score: 1

Playboy is porn? Maybe to you it is but to me it is just naked woman. Porn in my opinion has to involve actual intercourse or extremely graphic nudity. My point is that who defines what is porn and what is not? Is a site with just topless woman considered porn?

  8. With Visuals on Final Fantasy Concert Series Coming to the States · · Score: 1

This reminds me of the concerts that Boston Pops with John Williams used to do with his movie scores. They would show a scene from Jaws without the music and then the orchestra would perform. It really showed how important a good score can be - even if it is just background music.

Spoken like a true techie. There is no such thing as going overboard with something like this. It is a one-time cost sink that can save some huge headaches (and fines) down the road. Most companies are completely lax in their internal controls and ripe for employee fraud and financial mistatement. This is something that never should have needed legislation to be done in the first place.

You make an excellent point that I didn't even think of. We love to glorify pirates and knights in games and movies but the truth about them is often much harsher than what we portray. Does anybody really believe that all knights were chivalrous dogooders riding from town to town saving damsels in distress? It is all a matter of how far separated you are from the event and who is telling the history.

That's the best part about having a nephew. I am about ready to graduate him from Duplo to Lego this Christmas. I had bought a regular truck kit but it was mostly preformed pieces which he doesn't seem to like so I donated it to charity and stuck with a huge box of regular blocks.

And what if they really were ok with this? What exactly is the problem with portraying the horrors of concentration camps? Obviously it isn't for children but it isn't like the guy has everybody singing and holding hands. Why is it that the world wants to stuff the atrocities of WW2 into the closet to be forgotten? Doesn't that go against the whole "doomed to repeat it" thing?

The thing with both Lego games and Star Wars games is that they have been hit or miss (mostly miss). I wondering if combining the two very popular pastimes will magnify the effect making either a really great or really awful game. The preview says it looks good but I never trust that. The proof is in the final pudding.

It is important to see the world in shades of gray instead of black and white. That is the scientific way.
