Just how is software "unlicensed", and how does it become illegal to use it?
First sale, yes, that's SALE of any product, software, cars, CDs and so on are SOLD first, THEN you get to read some arcane "license" packed deep inside MS boxes. Sorry, THAT is not legal either!

It is NOT a license simply because MS stated that it is, it MUST have YOUR signature and "his" signature on a CONTRACT OF LICENSE, THEN and ONLY then is it legally binding!

When you pays your money, you buys your goods, your goods are yours to do with as you see fit, and there is NOTHING MS can do or say about it!

Placing a pricetag on software ELIMINATES MS "ownership, right and title" to THAT package!

Look at your driver's "license"....does that also not require YOUR signature BEFORE it is valid?
Even the states REQUIRE your signature before anything is "validated", MS is NOT the law and can NOT enforce EULAs on you at their discretion.

Prior sale rules OUT any clauses MS might have included within their products. No matter what ANY attorney states, it is not legally binding upon the end user simply because he/she clicked OKAY to the agreement during installation of his/her software. It was paid for BEFORE the "agreement" was known or viewable, which makes such tactics ILLEGAL and NON BINDING in ANY court of law.

Show me even ONE binding license or contract that neither requires or needs any signatures from either party upon it to be legally enforceable, not one I dare say has ever been created nor upheld in any court proceeding!

*Same software CD, six machines...SAME "license".....ALL non binding*!

Software is "sold" NOT licensed, or it should be freely given away as a condition to such a license. Anything else is not legally binding.

Adding another revenue stream into the river, one sees that the total revenue has just been divided up into 1/4, 1/3 or less/more BECAUSE of MS adding X-box revenue, or lack of it now. The actual revenue is tallied, but with a losing product like X-box, that too must be included. All profit/loss(P&L) lowers the total capital gains overall when stretched across multiple product lines, one will see a lower income over cost because X-box has yet to entrench itself deep enough in the gaming "scene".

MS "could" give away copies, but even I will admit MS has lgitimacy to charge something for what they have. I for one would love to see MS being broken up into at least three sub groups, run by NOT BILL types, and NOT connected with IT in any fashion either. To allow NOT BILL to maintain a grip on the subs would, or should reinstate anti-trust charges against MS for violating court orders, and violations such as this, would also bring contempt of court charges for going counter to the judges order, and willfuly I might add as well.

What SHOULD be ordered is that MS can no longer supply their software pre-bundled on ANY machine sold in the U.S.. This should never have been allowed, and if it is allowed, then MS should be ORDERED to INVALIDATE any "license" agreements their software has, even more so that they all come UNSEEN and do not have a copy of a "license" YOU, the customer must sign, clicking is NOT a valid form of contract or licensing, since MS considered the "license" to be legal and binding, it MUST be SIGNED by the SELLER and PURCHASER to be valid. No contract in this(U.S.) is legal nor binding without signatures! Why do you think you must SIGN your driver's "license" folks, even if it has YOUR pic on it? Even the STATES REQUIRE your hand signed signature for validity, MS can not supercede ANY state's requirement/s, or can they now?

New PC? Sorry sir, none of our products are loaded with windows, it's illegal to sell a PC with the "system" pre-loaded.
We "can" load windoze for you, at the going rate of $99.00, plus $25.00 service charge for our tech's time if you want to go that route.

That is what SHOULD be the method to business, not the way it currently is.

If MS wants to give away software, that's their business, but it should not be forced upon them, or anybody for that matter.

Since very few materials give near free-space resistance(Ohms) of 377 Ohms, we must separate the signal leads for the clock/s by at least 2-4 layers if the core speed is higher than 600 Mhz. Due to the shorter wavelengths of higher frequency CPUs, the crosstalk will negate the effort to increase FSB speeds and CPU clock rates while minimizing the latency built in with memory/CPU/FSB and controller speeds. Input and output signals will attenuate each other if they are not kept out of phase with each other constantly. In-phase signals cancel each other, but at the least, attenuate the integrity of those signals so that the data sent/received is garbled enough to make it useless for the CPU to use and transfer to the appropriate controller.

Rambus is a technology best left in the labs for the time being. Use what's best for your particular platform/s, use that if it functions well and causes no data loss or system lockups.

Board makers are too fast to accept anything that might grant a slight performance boost over a competitor's products. Choose the chipset/maker with extreme care and personal prejudice.

Bechmarks are tests that speak nothing of RAW power of the "system", but flaunt a CPU's core speed as the tell-all to total system throughput, which is NOT the real-world match to CAD, mathematica, or any pure processor hungry program that eats memory bandwidth and chews up CPU time performing several calculations and controlling functions in a split second. Heat is the "natural" by-product of clock speed/s, O/C'ing a CPU and then running a benchmark test to compare that against real world results is just a misleading application misused to amuse and confuse the actual processor's true capabilities.

The P-4 does NOT have any applications currently written that make full use of the high memory bandwidth it has, therefore, the current applications can't push the CPU to its MAXIMUM capabilities or speed/s.

The larger pipeline of the P-4 will slow the processor down if the data it handles is not written to make full use of that pipeline!

A quick perusal of the architecture will show you that the entire processor core is designed for programs and applications that CAN make full use of the pipeline, FSB speed, memory type and latency. Latency is both good and bad, if applied improperly, the CPU speed/FSB will become even more sluggish when the wrong memory specification is used with a chipset that over-allocates resources to the wrong areas; just as the right memory spec. used improperly will cause other failures with faster refresh rates, and memory dumps when the system is not "expecting" a memory dump. Limiting and eliminating board problems will become ever more problematic for main board designers with the ever increasing processor speeds as well as FSB speeds. A certain amount of "leveling" will be required for all component makers to play a little game of "catch up".

Stop designing CPUs with higher clock rates, and design a processor that USES the current speed EFFICIENTLY and PROPERLY, speed is NOT the do-all-end-all to the computer world. Show me even ONE application that suffers from NOT being run at 1 Ghz., nobody can I dare to bet!

Memory is now becoming the true bottleneck it once was when money was a factor, now it's compatibility between the "architectures" that has become the arch enemy. Rambus this, DDR that, SD there and so on...

ONE specification will rule Intel and another will rule AMD, you just have to sift through the B.S. spewed forth by those wanting your money.

Do a real test with your processor; UNDERCLOCK it, run it at the FSB speed if you can, or mod the BIOS to reflect that as close as you can. Does your application still run smoothly? Okay, slower, but stable, right? Now, return it to the normal speed, adjust the BIOS to reflect that as well, now run your application with different memory. Does the system still run stable? Time to swap to DDR next..same test, swap again; RD this time, and keep going. NOW, you have a base to judge what memory YOU can run stably, and without lockups.

Next, return the memory you have problems with to the store for a refund......YOU CHEAT!

I have a pair of 32 Mb. cards for my Compaq LTE5300, one is the correct speed, and one is slower, both cards work, but the slower memory caused the system to crash on cold boots, the "proper" speed card works no matter what. I have two LTE5300 notebooks, both do the very same thing when swapping these cards, so memory speed DOES make a difference, for me at least. I at least tested this in a real world application and based my findings from that. Your mileage may very.

Does anybody realize that the DMCA "law" is WORLDWIDE in scope according to Asscroft and company? Yep, that's right folks, the nazi states of DUHmerica has decided for itself that ANY U.S. law can and WILL be prosecuted against ANYBODY, ANYWHERE if the DMCA is "ciolated"(see Elcomsoft case here). Damn, that law must be airtight and legal in China too! If I were Elcomsoft, I would send letters to the U.S. worded carefully to indicate that the DMCA can go screw itself, and it does NOT apply in Russia, nor will it be allowed to be used against a Russian national(is there any sovereignty for nations anymore?).

Since when does the U.S. have the right or authority to enforce or act upon national laws OUTSIDE the territorial boundaries of the U.S.?

I trust THIS government as much as I "trust" a nest of aggravated hornets from ever attacking me for knocking down their nest!

I think the government(which I own) MUST be open to pubic reviews at any time deemed necessary, save for VALID security "issues" alone.

Not one bit of information that is NOT directly linked to national security can be kept from the public, and ANY attempt to circumvent(I love that word!) full disclosure to the public shall be fired from office and imprisoned for 20 years for TREASON against the citizens of the U.S.!

Damn, i want ALL the nasty "secrets" brought out into the open! MY money PAYS for their work, i NEED access to that work to ensure my money is spent the way it should be spent, and NEVER on golf outings and oval office blow jobs!

Clinton defrauded america by STEALING TIME FROM HIS DUTIES FOR A FRIGGIN' BLOW JOB! Hey! Can I charge "hooker time" to the county too?

The above statement is TRUE and is public knowledge, so Clinton has NO legal recourse to quash what I posted!(it's public record!), not to mention we ALL PAID for that BJ as well!

Monica, where are you...show me what Clinton paid for with MY money was worth stealing for.

Open/transparency for government will never work with what is currently in "power". We MUST destroy this by votes, and if that does not work, with guns next!

Want to eliminate financial crime? Make the government give everybody a million dollars when they reach 21 years of age, withthe understanding that this sum is ALL they will get from the government, what YOU do with it after you get it, is YOUR business, lose it, you get no more forever! Can't work you assume...HOW? If this "kid" were thinking of robbery to get money for food, then YES, it WILL work! We have big business stealing money from YOU right now, and you don't care, so why care if some 21 Yr. old gets "rich" for "free"...to build a life, business, home or...?

If we ALL had money, then the "need" for crime WILL be reduced to a single digit statistic.

Why steal a candy bar when you can buy 10 million of them? Same goes for cars, clothes and more...the money IS in your pockets, no more "need" to deny another of his/her money, right...YES!!!

Money in the hands of everybody will do nothing but GOOD, and the "ills" of a poor society will be relegated to paperback rags in some historical archive.....

If this is not the case, then WHY do poor people STEAL MONEY then? If everybody is rich, then there is NO NEED to steal money to buy/get what you want or need in life...crime is damn near eliminated!

STOP! This is NOT a (score 1) post!

The only method of ensuring compliance and maintaining lawful activities with respect to surveillance cameras should include these:

    1. Use of ALL surveillance cameras and equipment for personal use and/or personal gain is a FELONY, punishable by imprisonment of up to 10 years and a $20,000.00 fine. Mandatory imprisonment of 5 years will be required above all fines.

    2. Use of the surveilllance equipment is limited to court ordered monitoring ONLY, and shall be monitored by a civilian compliance group with the authority to assess fines and penalties for abuse of the surveillance equipment. The civilian agency has sole authority and can not be suspended by any chief of police, sheriff or district attorney in any respect, nor at any time except by court order stipulating lawful suspension of surveillance activities for a specified time and purpose.

    3. Penalties for illegal use of surveillance cameras and equipment for personal gain shall be the termination and loss of all pensions, benefits and medical payments, nor limited to the prior, but can be expanded to include any government plan or plans for the party or parties found guilty of said abuse/s.

    4. Additional penalties shall include the MANDATORY FIVE YEAR(5 year) prison term in a federal penitentiary and loss of ALL government benefits as of date of first indictment, and shall be non-reversible and forever in force.

    5. All public surveillance WILL be posted on the public internet at the same time the video is streamed into the headquarters for surveillance, and shall be forever made public barring ONLY that information that is to be used in a current court hearing/case to minimize the potential impact on jury tampering and intimidation. The civilian agency shall coordinate this effort with the courts and the district attorney on the strict compliance and application of any and all surveillance video used and stored for such action, but such "evidence" shall be fully destroyed upon closure of said court hearings/cases and no records shall be maintained, stored or archived for future action/s.

    6. No officer, agent or public official shall be in a position of authority above the civilian agency at any time, and any person or persons attempting to coerce said agency personnel into actions not within the scope of their authority shall be guilty of a felony and fined a minimum penalty of $2,000.00.

    7. Any officer of the court who, shall knowingly, or willingly involve him/herself in the actions stated above, and by doing so places these persons in a position of distrust of office and shall be suspended without pay for the duration of an investigation. Pending the outcome of said investigation/s, the involved officer/s shall either be fired, fined, jailed, imprisoned and fined, or both upon finding said persons guilty of any of the above illegal acts.

Checks and balances ARE needed, and when applied against those that do the surveillance, they too WILL be less likely of violating the law, with penalties four times harsher than you or I would receive, and rightly so. Those in positions of authority should be held to the highest standard for being placed into the public's "trust".
Loss of the public trust is a sure way to go directly to jail and lose those bennies you get.

Surveillance cameras shall also be placed in the headquarters of the surveillance "command" for compliance with the above laws and these cameras will have time-lapse recording of ALL persons entering and leaving the surveillance "command" center. The recordings shall be used against all persons violating the surveillance laws, plus all recordings shall be made public pending the outcome of any hearings brought before the court for prosecution so the public has full knowledge of the person/s involved with the violations of the law. Convictions places the involved parties on a federally protected list of every person forever barred from any public service for a period of 20 years, this includes political offices, financial institution offices, and all law enforcement positions(excluding any positions NOT requiring the use and carrying of a firearm) for the position of enforcing laws of the U.S., state and local jurisdictions.

THEN, and ONLY then, is it "okay" to have surveillance cameras placed in and around any city! I fully "subscribe" to monitoring the ones that monitor, and also ensure those in charge are above any and all persons in positions of any authority, that is the only true method to maintaining full and accountable control of all surveillance activities, bar none!

The reason officer "friendly"(yeah, right!) This cop has the ability to use that information against you at ANY TIME he/she chooses due to the nature of the job he/she has. THAT'S why joe nazi cop CAN'T and SHOULDN'T have access to the information, plain and simple!

Okay then! Just leave every scrap of your personal information open to everybody, anytime. police would LOVE to know even more about YOU, your family, job/s and how much you make and save in the bank/s. Gee, "nothing to hide" should really mean nothing to worry about from the nazi police we now have? Does WWII nazi Germany and Hitler ring a bell? How about the Stalin purges? It IS coming HERE now, and sooner than we might expect as well!

Sure, "honest" folks have nothing to "fear" but their personal RIGHT to live FREE and PRIVATELY whenever and wherever you want, NOT who, what, when and where the police dictate, THAT is certainly NOT freedom!

I think it would be time to take baseball bats and wrist rocket slingshots to those cameras! How dare the police make policy!

Since when did the police have the authority to use public money without voting on the expenditures? That is THEFT and FRAUD!

I am so damn happy that I do NOT live anywhere near D.C., you fools will be under ever more tightened "security" of the nazi police, and if you go along with this, you DESERVE to be snooped upon every place you tread! Think of the money they will make off of you for jay-walking fines, and who knows what else "they" will think up next also.

We have a constitution that grants RIGHTS to privacy, freedom of travel and personal security(2nd Amendment), why accept this blatant form of infringement of rights such as monitoring your every move? I damn sure would be whacking those cameras right off the mounts! NO police department has the authority to bypass the voter when THEIR money is being used without their authority or approval!

    DESTROY THE CAMERAS!
    PAINT THE LENSES!
    SMASH THE CAMERAS!
    CUT THE WIRES!

Do nothing, live with a totalitarianistic "democracy" that YOU answer to the police for your "right" to travel.

1> EMPLOYEE: Any person whom is hired to perform work/duties on behalf of the employer, and who is PAID by that employer, and enjoying any insurance/s, 401K plans, retirement bennies and so on. The employer takes care of ALL taxes being taken out of your paycheck/s, which includes federal and state, if your state has income tax that is. This IS what an employee is.

    2. CONTRACTOR: Any person who does work for a company or corporation, but is NOT hired by that company or corporation on a permanent/temporary job assignment(see roofing contractors here). The contractor is the person providing a "service" with his/her labor, thoughts and more. This person is never hired by the company or corporation at any time, and said businesses pay the contractor a higher rate of pay than regular employess due to the fact that the contractor is solely responsible for ALL taxes, unemployment payments, insurance and equipment(capital expenditures)as well as all advertisements, telephone calls and the list goes on....You are contracting your services to the business for work they either can't perform themselves, in-building, or do not have the expertise to do the work they are paying you for.

This always comes with a CONTRACT, stating terms of payment, work to be done(by you) with terms of service(duration of said contract) as well as your needs while performing the work. There is a lot more involved than what I am typing about, but the gist of the basic employer/contractor should be plainly visible and discernable between the two "types" of "employment".

Hmmmm, I saw a box labeled Turbo Pascal, it solely referred to the contents inside as software, it did have a price affixed to the outside of said box. And the price was $39.88(1984 dolarettes that is). I saw NO mention of ANY license, not on the box panels or back. There was an "agreement" INSIDE the box, but that was found AFTER I PAID FOR IT! My money PAID for the SOFTWARE, not a license, no matter what "they" tell you. I did not pay for a license to use my car, house or Piper Cherokee, why would I pay for a license to use some cheap software? When a price is affixed to ANY product, and you spend your money on that product, you OWN what you paid for in its entirety! Too bad the data is "captured" ona plastic disk; that's NOT my concern. If "they" SELL software, they SELL the DATA that is also on that disk, as well as ALL documentation that is packaged with that disk or disks. Since the data IS part and parcel, a part of the disk, then, that also BECOMES property of yours since you paid for it. Okay, if this license is simply for "use", then I want the software company to BUY BACK the software I paid for when I am finished using their "license". I might lease a car, but if I don't go over my "allotment" of miles, and return the car in the same condition I got it, I get money back, why can't I get money back after my "lease" for said software is over? If I can ONLY maintain physical control of software, but never own it, why am I "responsible" to the developer for its "safety"? There was never any contract signed, and I never agreed to become a "caretaker" for the developer, so how did my purchase(I did type PURCHASE) become a lease of sorts now?

One-sided "licensing" is NOT a legal nor binding contract by law, no matter WHAT some EULA states!
M$ does NOT have the authority to make laws! No matter what developer states in any EULA, it is not a legally binding contract/agreement. If ANY software is SOLD for a PRICE, then when it IS sold, it is SOLD in its entirety, and there can be NO license affixed to YOUR property that you legally paid for. Prove I do not "own" my copy of Turbo Pascal. The sales receipt is still taped to the box, and that in itself indicates OWNERSHIP, not a license. I can also sue for THEFT if MY copy of Turbo Pascal is stolen from my home, and since I can SUE for damages and criminal "intent", I can also assert OWNERSHIP of that which was taken from my property, including MY copy of Turbo Pascal!

So, you see, software really IS the physical property of those who paid for it, and not a licensed object of nondescript "value" or garbage strewn about the roadside. If it can be sold for a price and it is purchased for that price, then it becomes the property of the purchaser, and no other can assert ownership of that property, INCLUDING the developer of that software.

To SELL one's property to another, you LOSE control AND ownership of that property is full, and forever. You can not retain control after you set a price and DISPOSE of the property to another. The machine I am typing this on has both Linux and Windoze loaded, it came PREPAID with Windoze, so I OWN the copy that was installed when I PAID for it, it's now MINE and MINE alone!

Try taking it from my home and you can be thrown in jail for THEFT, so it MUST be MY property if it is a CRIME to take my copy of Windoze from me!

If you think my assertions are foolish rantings, PLEASE, by all means, attempt to breakl into my house and take my copies of software...I'd LOVE to see ANYBODY try it!

Oh wait, stealing is illegal, or is it now? I forget all too easily on this one for some reason!
