You forgot one very basic premise here; it's called PERMISSION to access PRIVATE PROPERTY!

No matter if it is a computer or real estate, the same protections apply all the time. M$ does NOT have any "right" to access your private property without your consent, and they can not deny your rights just because the EULA says so. No person, corporation or even the government has the authority to decide for itself that your rights do not apply. M$ can't arbitrarily trespass and snoop your computer without your specific permission, and to do so IS a criminal act according to private property laws. M$ would have to cross ONTO your property, albeit by proxy, in order for them to "check" your property for "updates" and "compliance", no law or laws can be made by a corporation that grant specific rights to themselves to trespass "covertly" and steal private information for their use.

For M$ to do so willingly would grant them a trip to court for criminal trespass, breaking and entering and also criminal damage to property with the "intent" on industrial espionage(yes, it's still espionage in that M$ IS an "industry".).

M$ could not afford to fight a drawn out battle on several "fronts" that would surely arise if they were "found" snooping and stealing files and data from private property, both corporate and private.
They could not survive a few hundred thousand suits claiming theft, espionage, and trespass.

Really, what else could one call a corporation's snooping and theft of private property and information? What"use"does/would M$ have for information that is not "normally" available to a person or company without having "intimate" knowledge of that person or company/corporation?

If simple, unenforceable EULAs become the norm in the U.S., then that very "agreement" could simply be written on a note and taped to a door by a theif that wants your stereo system...hell, he provided a EULA outlining his intentions, it was "delivered" to you.......Trespass officer? I think NOT! I forwarded my EULA to them, they didn't "object" to it, so I assumed my "right" to enter into the property.

*Reading this message indicates to us that you are in agreement with the planting of our feet far up your behind, and any damages that arise from the application of this EULA, you hereby agree to hold harmless, all persons and actions and also waive any right/s to remedy or redress under this agreement*

According to what I have learned in the past concerning "licenses" and such; one is bound only to the terms of the license that was originally included and signed, no others are legal or binding as the document/s first agreed to never included information or warnings that any such license could, at will, be changed, modified, rescinded or denied. Based on land contracts and property sales, ONLY the first, original document is legal and binding IF it is signed by both seller AND purchaser, with every clause well defined and retained rights of the seller are previously known to the purchaser BEFORE the "license" or "contract" is signed and/or notarized. Not one legally binding contract or license is one-sided! Two parties MUST sign any and all documents before being legally bound to said contract or license.

That darned drive was rock-solid stable and i never lost any program info stored. This is almost like kids that lived near railroads....we all laid pennies on the tracks for the trains to flatten(what fun too!). As long as the drive is somwhat "cared" for during the surgery, the drive will probably last well into two or three CPU upgrades and then some. My ST-225 heads were coated thick with dust during those two years, but never failed to perform like a new, unopened drive. Damn, those ceramic heads ARE cool, and to think that <50 millionths separates the platters from the heads too!

Okay, how much DOES a T1 installation cost an ISP to warrant such high costs to the end user? If every customer on their network pays that amount for a T1 line and they have 100K users, how much does that "service" really cost to implement overall? Is T1 gear THAT expensive? I doubt that. We have DSL service in my area, but not fro out of town customers, the loading and throughput would go down the toilet after a couple of miles, so, T1 is not an option for us, and cable is also not run out this far outside the city limits yet.
So, I am stuck with lousy dialup service for $19.00/month. I signed no contract, no agreement for "unlimited" usage. If I had a legit use for a server, I could run that from the house and nobody would ever notice this at "my" ISP...they are ALL brain dead there. They have "service" from 7AM to 10Pm monday through friday, but call them, and you get voice mail, no live bodies EVER answer the phone at NEWNORTH NETWORK of Rhinelander, WI. Tech support is by a few kids fresh out of high school there, and family members of workers of Citizens Comm. also. They NEVER hire from outside the company, I tried for years to "get in" but since I was not related to any employess there, my resume got "filed" in F-13(trash can) as we call it here. How many /.ers need 3 attempts to connect to their ISP like I do? Errors always pop up on the servers, and I can never establish a good reliable handshake even after initial connection is established! I ping the network and get no reply on any port I choose, and even port 80 is blocked, which is the port NNN uses almost exclusively! Since we have a "few" other ISPs in the area, I stay with NNN due to having our telco service through Citizens, so one bill is easier for me, but not from ease of use, just less paperwork to peruse. We tried the "others", but BFM has too many outages, and Go2America is also unreliable as well. The next ISP wants to bill me in 20 hour "blocks" of "limited" I-net service(bullshit!)for a paltry $15.00/month no less(who thinks this crap up anyhow?). I use 20 hours in less than 2 days, but a month..really? No wonder ISPs are dying, and good to know that too from my take on things that is! Screw the people making you money, you deserve to be out of business fast then. This makes as much sense as a credit check to get cellular service when you own your home...why does anybody need a credit check for a damned cellphone anyway? I am so happy I disconnected my service a long time ago! I had cellular service since 1983, so after all those years of super bills, I finally said to hell with it and dumped my provider and saved good money in the long run too! T1, ADSL, DSL. All names used to steal money with highly touted connect speeds and then getting limited with how much you can D/L from the public network...RIDICULOUS folks, really! No T1 gear is so costly to install and get running as to be worth $50- $100.00/month just to connect at above 56K dialup! Those fees are bogus and a clear format of greed I have ever seen. T1 costing $500 and upwards is NOT a benefit except to the ISP.
Do the math...35,000 user at $69.00/month covers not only the service, but the equipment, technicians and all overhead of operations daily! T1 is the BEST form of RIPOFF for internet access I have ever known, and is NOT worth the money just to D/L U/L faster than 56K dialup.

Technology eases the ability to obtain any other technologies such as better/faster computers, design software and test/emulation hardware for "hacking" the "obscure" devices we in the western world take for granted and never think twice about. The obscure tech. is easily obtained, reverse engineered and then implemented as a base for controllers, timers, and rudimentary navigational systems. How much MORE damage could a SCUD do IF it were outfitted with a simple navigation computer? Plenty! Point and shoot has proven the destructive ability of the SCUD, and it's devastation would be greater if it also incorporated even a simple single board computer. Since those are easily bought and shipped worldwide, what is stopping anybody from using that as a nav-aid for ever MORE destructive weapons platforms? Technology enables AND disables us all at the same rate. It's HOW technology is used and designed into equipment that gives rise and fall of technology's wonders and shortcomings. Use defines abilities to some degree, but denying technology can also create negative side effects as well. Money decides who gets what, and when. It's an "evil" that has no equal in a global economy, and any attempts to quell accessibilities to technologies will provide black market sales and acquisition of "illegal" technology hardware. Sorry, you can't "lose" service due to a "cable hacker" butchering his lines; that only adds increased noise ingress if he is downline from the "offender", which, of course, is only for the forward path and NOT the reverse, since the analogy is now backwards; "his" noise ingresses will be seen on your set with the 5 to 42 Mhz. reverse path "backfeeding" in through the tap that serves your residence.

The amount of signal degradation will also depend on how far you are from an LE(line extender) or a trunk amp. The ingress in either the forward or reverse path depends on the level of noise ingress that is present on the lines, and the distance the offending home is from yours, and the true signal level that is available between the two homes.

Run an SLM on the amp's output, then take a reading at your input and output; then do the same to the offender's tap, and finally, take an EOL(end of line) reading at the last, terminated tap. A Wavetek "stealth" meter will give you a very nice picture of C/N, ingress, C/S and since you can tune any specific channel, you can "see" what bandwidth the ingress is taking up on your street's plant. Do a simple walk-out of the plant and note the location of ALL the amps, taps and splitters from your location to the offender's.

Cable IMD/ingress is easy to locate if you use common sense in the approach. Many's the time, the splicers do the initial setup of the forward and reverse paths to take readings and get the node up and running for the "final tweaking" of the node certification/sweepers to ensure the levels are within tolerance, if this is not done properly, the whole node suffers from ingress, intermod, crosstalk and bursting(level spikes).

Cable modems suffer the worst from reverse path noise, that shuts down the bandwidth available and slows total system throughput. I set up thousands of nodes in MN, WI. and Iowa, and the one thing that takes a system down fast is noise and IMD. IMD corrupts data greatly, and the BER drops significantly because of it. Ingress and IMD look like false data packets, and cause falsing to occur, which of course, decreases the valid data that is outgoing and incoming to/from your computer.

The first (CR)Apple was built inside a wooden box! It didn't even have an 80 column display, but later production models could be had with an 80 column card under the "hood", not to mention the memory cards and so on....
The ][ came after the I, then the Lisa and the Apple III, then the ][-C and the Gx and Mac, Mac-II, Mac-SE, SE-30 on over to the IIFX-xx variety, albeit, this is NOT in chronological order, it is an "attempt" to show lineage of the (CR)Apple line. As for being "first"....NO! Recall the Altair and MIPS varieties...care to do binary and flip switches to program...AAHH, the "joys" of owning and using those, plus anything with the S-100 bus architecture!
    <div>
I still have an original VECTOR S-100 "PC" with TWO 5-1/4" drives, 128K memory, "video" card, controller card and keyboard. Also how about my two Osbornes? The difference in the two being the first had a ribbon cable connecting the "computer" to the keyboard, and the second, using a coiled cord. Oh, they both had 2, 5-1/4" floppys, PLUS a 300 baud modem for fast BBS access! Now THOSE were the days my friend! Damn, those Osbornes have such a small CRT to view your data, but being monochrome, you had no choice but B/W. I have both versions of the Osbornes, and they are damn near like new, complete with manuals. History should NEVER repeat itself...NEVER!</DIV>

SHITTIEST ISP in the northwoods! I called the Wis. branch of the consumer protection agency for the extremely high disconnect rates I was getting(30 a day!).

Dead server/routings active, no data being received, even my pings failed on all ports.

Now, AFTER the C.P.A made "first contact"; BAM!, my connections have been stable, and the disconnects have gone down to just a few!

NNN liked to blame my commercial repeaters on my tower for the "real" reason I was being DC'd so much(sure, and the cop's radar is safe held between his legs too!).

Sorry, < 1mV will NOT cause my internal modems to lock, or disconnect!

I have LESS than .02mV ripple on my lines during all repeater keys, and they are all 30 watts output from the duplexer, and 265 watts ERP at the antennas(10dB collinears, 3 degree electrical downtilt). Proper shielding IS the only answer to maintaining a CLEAN signal path, with no crosstalk or intermod products gaining ingress to the audio and R.F. circuits. Not to mention, all my systems are UHF and not CB grade junk N**tel runs!
