How about going after the people who own the links in the body of the spam? Although it may be difficult to discover where the spam came originated, it's pretty clear where it wants you to go (probably the person who commisioned the spam in the first place.)

If Apple added the credit card number that was used to purchase the AAC file to the key, then I'll bet people would think twice about sharing their protected AAC files on Kazaa.
