I think the problem may be that earlier it defines:

The term ''amateur station'' means a radio station operated by a duly authorized person interested in radio technique solely with a personal aim and without pecuniary interest.
The spirit, I think assumes that a broadcasting station has a pecunairy intersest. Since many of the Streaming radio sites ask and take donations, I think that may qualify as a "pecuniary interest".
But many of these stations are going to be charged this fee even when many of the artists it playes are not invovled or helped or controled by the RIAA.
I think everyone is falling into the false thinking that something is "secure". An operating system is not ever "secure period". Security is an ongoing process. People need to learn how to check for security updates, and need to learn to keep up to date. (This alseo does require that vendors provide prompt patches, but for the most part, all of them do).
I try to use OSS products where ever I can, but I think some people go way overboard. If there is a _good_ commercial product (Not talking about Ms Office) that has the features I need, I will pay for it. Think my idea is crazy? Ask Linus Torvalds why he is using Bitkeeper.
I'm pretty sure a similar side calling for bombing a institution in the united states with dedicated plans...
Ok, the difference is this. If the information was advocating and calling for the destruction of properity and lose of life, that speech would be restricted (because it is intended in incite violence).
This happened a few years back in the states with a group of Anti-abortionists had a web site that made "wanted posters" of abortion clinic doctors and put big Xs through them when a few were killed.
In this case the info was not an order to go out and use the information to kill people, just simple information.
I don't think the RIAA would recoginize this as falling under the catagory of an internet simulcast.
I think the usually say "by opening this blah blah" not "by breaking this sticker", on the cd pouch thingys.
Besides if that EULAs are accepted in court, they would go by the spirit of the law, not by some stu^H^H^Hcreative workaround.

Well there are probably major FCC isues involved. I am sure this loophole only applies to FCC Licensed stations (its not cheap to be licensed)
