    ...suitcase full of old black&white photos...

    You mean brown&yellow photos? And so easy to transport and find what you want... And if you have two kids that move to different towns you just use your magic to give each of them the same suitcase, you also keep it yourself...

    Oh, those old B&W photos have writing on the back to tell who's who.

    I bet the handwriting is always excelent and oyu can easy search for the person you want to see, and don't forget - ink never fades.

    Therefore, that clause may be considered discriminatory and overreaching, as it endeavors to *take away* a right that the licensee already has, independent of the license.

    No, you still can sue. All that is taken away is the right to distribute the software, wich was given by the license.

    There is code where the BSD license is better suited for the job, think ogg and vorbis libraries. Mostly you benefit form a BSD style license when you have to set a standart, but IMHO a copyleft license is better suited for applications.
