software in this hypothetical situation? Can
they develop it further? Can they fix bugs?

he was running a monopoly and doing lots of bad
stuff, he should be allowed to keep his ill-gotten gains and keep operating. It comes
down to should some person or group be allowed
to act in a criminal way if they are also
providing a useful product or service. I would
say "no".

The GNU manpage for sendfile says it's not portable and shouldn't be used. That's good enough for me, don't use it.
VERSIONS
sendfile is a new feature in Linux 2.2. The include file
is present since glibc2.1.
Other Unixes often implement sendfile with different
semantics and prototypes. It should not be used in
portable programs.
