If laws like this are actually applied and not just presented to the media to polish the legislator's apple then it will kill spam. No matter how big the industry seems no one who makes a living at it could survive the fines.
Just like mail and the telephone e-mail is there to be a convenience for the user, not the advertiser. Any abuse of this should be punished.
When this all started really bubbling up I recalled reading several articles about the bug in Infoworld in the mid-late eighties, and thinking "they aren't going to wait until 1999 to start fixing this are they?"
D'oh!
Although it is often a little late Apple does seem to respond to criticism more so than other companies in their field. When they had that trouble providing faster G4s and had to rejigger their offering and cancel orders after the screaming they did the right thing by the people who had already ordered.
My issue would be that frequently they flop on both accounts:
1. They don't seem to think about the strength of the negative reactions before they do something boneheaded
2. After the bonehead move they react too slowly to get any real goodwill in return for their "corrections."
