In the beginning was the Plan and the Specification.
And the Plan was without form and the specification it was void. And darkness was on the face of the implementation team. And they spake unto their Leader, saying, "It is a crock of shit and it stinks"
And it was the Leader and it was the Project Head. Now the Leader spake unto the Project Head, saying, "It is a crock of feces and intolerably malodorous."
And it was the Project Head and it was the Department Manager. Now the Project Head spake unto the Department Manager, saying, "It is a container of excrement and its effluvium is very strong."
And it was the Department Manager and it was the Product Manager. Now the Department Manager spake unto the Product Manager, saying, "It is a vessel of fertilizer of overpowering strength."
And it was the Product Manager and it was the Centre Manager. Now the Product Manager spake unto the Centre Manager, saying, "It containeth that which aideth the growth of plants and strong it is."
And it was the Centre Manager and it was the Director. Now the Centre Manager spake unto the Director, saying, "It promoteth growth and it is very powerful."
And it was the Director and it was the President. Now the Director spake unto the Vice-President, saying, "This powerful new product will promote the growth of the Company."
And the President looked on the product and saw that it was good.
I was pointing out that SCOX is in all probability estopped from doing any thing about it. They endorsed AIX 5L on the power platform. It would also seem that it is SCOX that is limited to the Intel platform not IBM as is pointed out here and here
Great article at Groklaw about this very thing. Note it's from a year ago.

SCOX is in violation of their licensing agreement with open group. I'm guessing they will lose this one and may even lose the right to UNIXWARE.
From sectiopn 4.1 of the agreement:
4.1 Combination of Trademarks in Product Names
...
Licensees may combine the UNIX Trademark with their own trademarks as a product name, provided they seek prior approval by submitting the proposed combination including a sketch of the proposed use. If approporate, to X/Open Company. X/Open Company may ask to review a proof of the final artwork.
Licensees may use the UNIX Trademark as part of the proper name of a product.
...
The License specifically prohibits Licensees of any Trademarks from registering with the relevant trademark authorities specific forms of the Trademarks including Trademarks used in combination.

BayStar is real big on PIPEs.A PIPE is a private investment in public equity. In a nut shell it allows investors to quietly pump money into companies. Who is on the top 10 list of investors in PIPEs since 1995? You guessed it Microsoft. Go here for more information.
I've got a Radio Shack model PC-2 Pocket computer, one of the first portables sporting 8K of ram, and an IBM PC XT with a NEC V-20 overclocked to a whopping 8 MHz! Running Autocad on the XT with my smoking 16 color Techmar graphics master.
The last time I used Sun's C++ compiler, the only problems I had were with the antiquated version of the STL that they insist on using for backwards compatilibity purposes.

17.46. Deceptive Trade Practices Unlawful
Text of subd. (24), as amended by Acts 2001, 77th Leg., ch. 962, 1, effective Sept. 1, 2001.
(24) failing to disclose information concerning goods or services which was known at the time of the transaction if such failure to disclose such information was intended to induce the consumer into a transaction into which the consumer would not have entered had the information been disclosed;
It would seem by not divulging exactly what they are trying to license they are breaking the above law. If they said gimme $699 for GPL code would you buy it?
SCO says that it will deliver a Linux-compatible environment based on the UnixWare kernel by the end of the year. It's different to, and way more ambitious than SCO's lxrun emulator.[.....] SCO/Caldera, or as we'll refer to them for convenience from now on, Scaldera intends to ship the environment by the end of the year. At the session, SCO officials said that the the environment amounts to around 40,000 lines of code, plus around 2m drawn from the real Linux kernel tree.
The last paragraph is worded so strongly, especially the bit about fraud and IP theft, you can't help but wonder if some unnamed soul hasn't laid their hands on a copy of SCO's code and found GPL'ed code in it. The Linux personality module comes to mind.
But what is preventing SCO from adding in code from Linux (which is openly available) into their (closed) UNIX code and then claiming is was there first and was 'stolen' by Linux? C'mon, we are not expecting SCO's management to play fair here - how hard would it be to backdate code additions?
They could fake up their source code control system repositories with little effort. But they would not be able to demonstrate a check out and a build that would match any binaries they shipped.
Funny thing, copyright is... No, if software comes with hardware you can NOT do with it as you wish. If you buy an HP computer (with windows on it), you can't decompile windows. It's in the EULA
Copyright has no realtion to a EULA, and EULAs are not laws, at most they're contracts which you may or may not be a party to.
Correct. I can buy a copy of XP and decompile on a linux box with no worries as I have not agreed to the EULA. Even the Stalinistic DMCA allows for this under the interoperability clause
So, in essence, sellers on Ebay are as easy to track down as sellers in brick & mortar stores or otuer public places of business, with business licenses, vendor's licenses, or other government checks and controls... I fail to see a problem with that.
I'm not too worried about them releasing a mailing address. It's the ease with which they release financial records that's a real concern.
Looks like Italian to me. I found this site nearly a year ago, IIRC, and they still have not released the source code. The phone it's self is pretty cool, as is what they've done to the kernel. It's got a little hard drive in it and they've tweeked the file system so a fsck is not needed if tou kick the plug. Still I'm wondering if they will ever release the source.

One vote for Cinelerra. It has its quirks, but if you work around them and save often, it's a decent package.

Groklaw has a paypal donation button. Give them a few bucks for all the good work.
Option number two. Boies can sell off his SCOX stock in March 2004 (IIRC). That's all the longer he's got to keep up the farce of having a real case.
