This is just Microsoft protecting their own turf. This is part of their culture. As a publisher they feel they must prevent anything that might jeopardize that income. Most companies would not go this far, but Microsoft has a culture of "cutting off their nose to spite their face."

For the current going price it is worth picking up. For more than $10, you should skip it.
It is cheesy and cheap and honestly not much better/worse than most Duke ever was. People expected much more than they should have. Of course lots of those folks are not even old enough to have played the originals.

Having the webserver not report the OS is pretty simple to do.
Mac Adresses are spoofed all the time. It is trivial to do.
They do have IMEI numbers that are unique, but again can be changed or spoofed.
There is no need to change hardware to spoof an id, just have the software lie about what the hardware id is.
