Because people aren't machines, and by having a philosophy that precludes rewarding them for personal performance (and an inability to whip them into submission without incurring the wrath of the global community) you guarantee low productivity.
I think the problem is that Obama is ignorant of the 19th/20th century slang usage of "bully" as TR used in the phrase "bully pulpit", and thinks that he has to actually act like a bully. He claims that he can get things done without Congress because he has a "phone and a pen," launches personal attacks against legislators and his critics, and uses the genetic fallacy in his arguments regularly.

Besides being a post-hoc argument, please note that the existing regulatory environment is quite different from much of the rest of the world. And I could point out nations like Australia, where internet access is heavily regulated yet the performance is low.
I'm not sure where you get the idea that the public interest trumps actual written law, but it doesn't. That's a mob mentality. So you might then think, "Oh, then let's change the law so that the IP of failed companies goes into the public domain." Congrats, you've now made it impossible for entrepreneurs to obtain loans, as they have nothing to borrow against-- they don't even have any physical assets, to begin with.
I'm not concerned about all that stuff that Obama has no, or very little control over. I'm more concerned about his extralegal executive orders regarding immigration and suspending the employer mandate in the ACA, and his failure to dismiss Holder for his incompetence.

Number two, if you want to eliminate prejudice, you make sure that things are not UNATTRACTIVE for people of certain sexes/races-- making it ATTRACTIVE for certain ones is simply another form of preference, by definition.
