What new games? Given all the driver and compatibility issues, do you really think companies are going to release DirectX 10 only games any time soon? I think not.
What is in it for Apple? Apple makes money on the iPod hardware but they do not make any money on the DRM. Assuming that they were able to charge a reasonable amount for licensing the technology to other stores, how could you be sure that their costs for maintaining not only their store but the licensees would be less than the license fees?
Apple already has the lionshare of the download market so they are already in a good position to negotiate.

Apple would save money if they did not have to use DRM and they would not have to update iTunes so often. It is often forgotten that many iPods were purchased long before iTMS was available in a particular market. Many also forget that many people own iPod but purchase little or no music from iTMS.
MSFT earns revenue from DRM through licensing fees and royalties from Playsforsure device manufacturers and music stores. MSFT has also implemented the Protected Media Path within Vista which will disable or degrade the performance of hardware which does not implement features to enforce DRM protections.
The WMA DRM has the added benefit of a platform lock in for the windows OS.
Many of us bought their first iPod long before iTMS came out let alone available the the country we live in. Canada did not get iTMS until December of 2004. I had bought a 2nd generation iPod in 2002. How did I manage to get music? I bought CD's and tried out eMusic for a bit.
I see that TPM has been mentioned. While my MBP has a TPM module, there are no drivers for it and the updated MBPs do not come with TPM.

There were windows only services that were focused on subscription sales and some sales of songs but the rights granted to the purchaser varied from song to song. Some songs could be burned to the CD once, others a few more times while others not at all. Some songs could be synced to music players while others could not. It was flexible from the perspective of labels but not very consumer friendly or consistent.
Enter iTMS, Apple insisted that labels provide universal rights to all songs sold on iTMS. This meant that all songs had unlimited burns available, all songs could be transfered to the iPod and all songs could be streamed.
Apple achieved such widespread and consistent rights because of Apple controlled the entire stack and it was only available on the mac in the beginning. It was an experiment to see if that approach could work. Once iTMS had proven itself, Apple bargained hard to ensure that windows users could get the same rights in the windows version of iTunes.
Apple's entry into the windows marketplace forced competitors to bargain hard for similar universal rights for their customers as well. It was a big win for windows consumers on the other services.
I do not believe that Apple would be able to maintain that level of leverage against the labels if they licensed the DRM system to other stores.

Apple UK ads say there isnt any spyware... Yes there is and there are programs to deal with them such as intego's internet barrier, smithmicro's internet cleanup and securemac's MacScan antispyware..... Apple should face reality. they do the security updates... Do you work for Intego? A while back Intego tried spreading FUD like you are spreading in an effort to get more people to buy their software. Are you aware that what they call spyware may be cookies that track you from site to site? It is not actually spyware but stupid people fall for the FUD all the time.
There are also some virus checkers on OS X as well. Does that mean you think there are viruses too? Virus checkers on OS X exist to filter out windows viruses from being spread by shared documents.

How much does a dinner with drinks, cab fare, club cover charges and drinks cost where you live? When I was a heavy party guy in my mid-20's, I'd sometimes use up a couple hundred bucks in a weekend. If drinks are involved, a cab is pretty much a must.
