    the DMCA requires the ISP to co-operate in removing copyright material upon receipt of formal notice and request

    if Seeqpod has been given the required notice they will have to comply, otherwise they are in violation of DMCA and they don't want to be there.

    I think actually, if someone sends a letter addressed to me I acquire ownership of whatever part of the content is addressed to me.

    I did a little quick scanning on the net though and couldn't find support for this, -- but for some reason when I read this topic that is the first thought that popped up

    if you think about this for a minute you see what I'm talking about is an essential characteristic of any message that is addressed personally to you

    for example: I order a book from Amazon. The order arrives and I have the book and the invoice. I can't misuse the copyright on the book but the invoice -- is mine.

    I think I read yesterday that 95% of computers are running ms/windows

    maybe so, i ain't got no way to know. but it is certainly true that ms/windows controls enough of the market so that any start-up will have to have a high degree of inter-operability to be viable

    I think though that if you can read Word and Excel documents the 90/10 rule will kick in and your ready to run

    the Solaris system has some pretty good looking stuff

    one of the main hack complaints in 2007 was when ms sent updates onto XP's that had updates turned off

    credibility to a serious hit that day

    not that it mattered at all, as I noted hackers made a feast of ms in 2007 with the result being that 'computer security' is now on an even par with 'honest politician'

    security has to be 100% because as soon as there is any breach at all you can no longer trust your authentication tools

    it's the concept actually, that it is ok to send out programming updates without a foolprof means of authentication

    this concept has resulted in 2007 being a banner year for hackers and cyber crime. they only result that can be drawn from all of this hacking is that ms/windows is not suitable for commercial business because of its inherent vulnerabilities.

    time to move on, and I've got my eye on that Solaris system. that is a good looking system and if that has good tight security, well hopefully ms comprehensive will cover glass breakage

    Hackers have been of some benefit, that being they have demonstrated to us, in spades, that "security" on our existing network is no better than a bad joke.

    If the internet is to be a component of the commercial business system the security problem has to be corrected.

    the troubles that we have on the network today are largely the result of UN-AUTHORIZED programming. Considering this, the first thing that needs to happen is we have to change our thinking about how we update programming

    un-authorized programming cannot be allowed, anywhere or anytime. we will need a commercial business type organization such as IBM to make the change,-- the stuff that comes out of academia just don't cut it.

    I'm talking RACF for Windows. We need to look at not only who is trying to update what, but also what tools are they using, and just exactly where did they get those tools?

    this is necessary to insure that only properly authorized changes are made to any programming

    when I worked in Payroll/Personnel in Richmond back in 1980 we knew this: if you spend 25% of your time writing code you have to be classified as a programmer and as a programmer you have to be paid hourly and overtime rules apply.

    the whole of the IT industry could never have mde it out of the 1960s and through to 1990 if that rule had been applied: nobody could have afforded it

    but is is time for the industry to mature

    we need to slow the pace of development and focus on reliability, security, and responsibility

    it just isn't necessary to write code at Mach 8 anymore. time for IT to grow up and take its place with all the other regular professions. we know how to do the work now, we don't need to experiment to learn. that is all behind us. except for 1 detail and that is managers still need to learn to manage a profession when both the development and supports aspects of IT are present at the same time.

    the software business is a mess. as a result you are going to get an intervention. exactly what that will be remains to be seen

    but hackers messing with the software affecting various aspects of the commercial system will not be tolerated

    the difference is that the net and the computers aren't toys anymore: they are a crucial part of our infrastructure. this will result in a change in the way things are handled

    it's past time, way past time, for us to recognize that software is a crucial component of our infrastructure. and like concrete, steel, electrical work, plumbing etc etc we have to have a means to make sure the job is done right

    part of "done right" is that the software does what the specifications say it will do

    part of "done right" is that the software does not fail: abend, loop, incorrout, wait state, slow -- what have you

    no software maker will be able to stand behind their product unless they have assurance that neither their product or the os on which it is run has been compromised by rats, trojans, spyware, adware, worms, bank robbers,geeks, hackers, goons, snake oil, virus codes etc etc etc

    enough already

    it is time to slow this industry down and get things right. for a change

    now I know what I'm saying here ain't real popular on this board. about as popular as dad showing up at a teenager festival

    alternatively we might re-examine content and use

    Cable systems already have "pay per view" channels and perhaps some of these should be used for streaming music and videos you guys want to access

    that might get the data streams for these materials out of the regular internet data channel

    too, much of the video and music is copyright material and to access copyright material will require a proper sales agreement.

    we have a lot of abuse going on which includes but is not limited to

    • distributing illegal software updates: virus, rats, spy ware, adware, keyboard loggers
    • spam, phishing
    • facilitating copyright violations, --p2p--
    • facilitating criminal communication -- "hushmail"


    now it appears the government may be looking into the entire mess and there are some folks screaming about privacy violations

    guess what kids: the supervision is warranted by the bad behavior and mis-use of the net. a done it to yourselves

    the rest of us have a right to have computer running without virus codes so we can communicate and conduct business without ditzy-bopping hackers trying to get in our face or rob us

    Anything that is this popular, by nature, will attract viruses.

    Yep. and so anyone who is designing electronics with the capability of receiving programming updates has got to consider how those updates are going to be authenticated. the method for this has already been developed and proven: all that is needed is an authorized PGP signature on all programming.

    this stuff is not a game. pcs, the internet, cellphones -- these are business equipment for corporations, employees, and individuals

    and all these people, I shall call them customers, -- have a right to clean equipment that functions in accordance with the manufacturer's specifications and has not been illegally modified with un-authorized programming

    that un-authorized programs can be "injected" into these divices is a disgrace to the manufacturers, -- which are technical organizations which should know better.

    I hate the thought of government intervention into any aspect of life but unfortunately that has been necessary in a number of areas. and it is looking more and more like that is the only way we are going to be necessary of the net.

    as a result it is important for document formats to be standardized by ISO or ANSI

    requests for change must be made public and slowed up so that everyone has a chance to implement -- so that backward compatibility can be assured

    certain document types need particular care:

    • PDF
    • HTML
    • rtf
    • txt
    • Comma Delimited
    • address book


    there are likely a few more

    these formats are so important to our data that support of these formats cannot be trusted to software companies. the specifications for these documents needs to become open, international standards so that
    • documents can be exchanged between disparate systems
    • archive documents can be retrieved from the past

    the protection of intellectual property ( copyright, patent ) has been known as "the lamp by the golden door"

    it is creativity placed in service that furthers the improvement of the human condition. placing new works inservice required venture capital and venture capital is available when there is a reasonable expectation of a good return. copyrights and patents are used to the returns on such ventures reward the rightful parties. without such assurance there is no point in risking capital to bring forth the development of creative works.

    this is the lesson of experience

    and as Dr. Franklin noted "experience is the only true test of any proposition"

    only un-educated fools would see any reason for any discussion regarding the usefulness of patents and copyrights.

    this is the bad with the good

    on the one hand i don't like the government making warrantless searches anymore than anyone else

    on the otherhand searching the internet is probably warranted, generally:
    • we have got hackers distributing, rats, trojans, spyware, keyboard loggers, bank robbers, adware robots and trash
    • we have got spammers out there trying to sucker people with "phishing"
    • we have got goof out there tampering with re-direction of DNS servers and setting up spoof sites
    • we have got gangs and terrorists using HushMail etc to facilitate crime
    • we have got thugs selling child pornography
    • we have got music pirates ripping the copyright law to shreds

    if i hadda vote today I'd prefer government supervision to the mess these hackers have created for us
