This trial is about whether or not they broke Swedish law. As slashdotters constantly whine on about, they claim they have done nothing wrong under Swedish law. If they are right, then what's the problem? the judge supprots Swedish law (duh... he is a JUDGE), and TPB guys claim innocence under that law.
If they are pretending to be freedom fighters who want to CHANGE the law, they need to talk to politicians, not a judge. In fact, your first step in changing a law is to get yourself lawfully caught and arrested under it so you can show its injustice. Thats if you actually give a fuck... rather than just trying to wangle out of a prison sentence at all costs like these guys.
BTW judges are set by politicians elected by the people. If they set harsh drug or copyright laws, then that represents the will of the people. If thepirateparty have 60% membership, you may have a leg to stand on, but the majority of Swedish voters clearly like the current law as it stands, and thus they fully expect (quite reasonably) that the police, and judges will enforce that law.
I would hate to live in a country where politicians are voted in to make laws, but judges ignore them. Only on slashdot would people pretend that's a good idea (just to justify piracy).
I have a legit copy. I store my business details and do internet banking from my PC. Why would I be dense enough to trust a copy downloaded from thepiratebay?
Theres no need to write trojans that bypass windows security and firewalls when there are people happy to actually get hold of a malware-infested O/S from day one.
The solution is preventing anonymous uploads. You need a paid account , say $1 a year to upload. That way if you upload copyrighted stuff, you are traceable and thus you would be mad to do so. If you really need to share top secret whistle-blower stuff, you use tor.
BTW, you say hosting the stuff is their job, not policing it. That is true. However if your business is knowingly and overwhelmingly being used by the same people to break the same laws, you should co-operate with the police. If you ran a self-storage warehouse and it was obvious 90% of the people using it were storing stolen goods, you can bet your ass the police would demand your co-operation tot rack down who was depositing stuff.
"copying and distribution of intellectual work became an integral part of our lives"
That would be YOUR lives. Not the majority of people. You DO realise that YOUR life is only possible because other people are paying for movies, music and software to get made?
If everyone acted like the slashdot crowd, you really would be all legal, because you would only have linux distros to torrent. Someone has to make all this stuff, and they have to pay rent and buy food.
here in the UK nuclear energy plants are always having mistakes, leaks, failures and worse: cover-ups as to their safety records. With nuclear power, this worries me. If every 50 years a wind turbine falls over, its really no big deal in comparison. If they are asleep and unlucky, a sheep might get killed.
I'd have a wind turbine in my back yard. i would not have a nuclear power station or waste storage facility there.
one of the best things about wind farms is that 90% of the land is reusable. I know of two big industrial turbines in the UK that are placed in car parks, with cars parked all around them. In rural areas, sheep quite happily co-exist with the things. The amount of land actually blocked out for use by the turbine base is tiny.
Why do the propeller blades have to assembled as single pieces off site and transported intact? Is it not possible to have modular blades that can be transported on normal sized vehicles and then assembled at the final location?
Excellent post. Nice to see not everyone here is waving a flag for NYCL and the abolition of copyright. And also good to see someone else realises that the only countries who will benefit from abolishing copyright are those like China with a decent manufacturing base. If IP is devalued, the USA is fucked, and the current generation of college kids are more fucked than anyone else.
you are correct, it should have been about $1500 max. Which is what the RIAA originally wanted to settle for.
And she refused
And she refused again
And again
And every time she has done so, she has made things way worse for herself, to the point where now a JURY choose to award the maximum possible fine just to shut this woman up. Even the RIAA admitted they did not expect to get, or want the maximum award.
The reason this court case has got so ridiculous is because she is either stupid, or advised by stupid people who want to use her to whine at the record companies.
Any sane individual would have settled out of court for the initial amount. She has nobody to blame at any point for this saga than herself.
"A vigorous defense from Kiwi Camara and Joe Sibley was not enough to sway the jury, which had only to find that a preponderance of the evidence pointed to Thomas-Rasset. The evidence clearly pointed to her machine, even correctly identifying the MAC address of both her cable modem and her computer's Ethernet port. When combined with the facts about her hard drive replacement (and her failure to disclose those facts to the investigators), her "tereastarr" username, and the new theories that she offered yesterday for the first time in more than three years, jurors clearly remained unconvinced by her protestations of innocence."
well the jury seem annoyed at the attitude of the defendant, and I'm not surprised: (from arstechncia)

Camara suspects that the jury thought Thomas-Rasset was a liar and were "angry about it," thus leading to the $80,000 per-song damages."
everyone in any creative industry throughout the globe does one weekends work and then retires?
This is news to me, as someone in that industry. But thanks for your dismissive, insulting abuse. Its what reminds us never to make music, games, movies or any other content aimed at people with your attitude. You may think content sucks. It doesn't, its just made for people who don't hate and loathe the content creators, and for those who are happy to pay others for entertaining them.
BTW if you REALLY believe your post, why the hell are you sat here, instead of on your private island after last weeks pop recording session? It's easy right? so why are you not giving up your career to do it?
I guarantee that as a humble poverty-stricken electrician you get paid way more per hour over the year than I as an evil copyright-owning royalty hoarding content creator do.
If its such a gravy train to make content instead of rewire houses, why the hell don't you change jobs? Could it be you prefer the security of a pension scheme and steady salary?
it does amaze me that people think that the whole of modern culture is frozen and unable to proceed because we cant do remixes of a black and white mickey mouse cartoon.
Wouldn't it be a disaster if we were encouraged to produce new content rather than remix old stuff? oh noes...!
"Stop producing cr@p that nobody is interested in"
They make movies and music for people who BUY it. If you are part of a demographic that is not buying music and movies, then newsflash! no content is being produced for you.
Music and movies still sell (as slashdotters always shout about when they defend piracy) so has it occurred to you that actually the majority of people out there buying that stuff actually like it?
It costs money to make games, movies and even music. People will not make stuff that they know they can't sell unless its a hobby. In short, if you want stuff you will enjoy, you need to send signals to the market by actually BUYING what you enjoy.
No movie or record company accountant gives a fuck that their product was top of the torrent chart. That cant be used to pay people.
The thing is, you are throwing all 'content providers' into the same 'useless, evil' box. There is thus bugger-all incentive to them to change their ways.
I provide almost everything that people like yourself are asking for. No DRM, free format-shifting between versions we have available, free demos, decent fast customer service, yada yada.
The fact remains, people like me who try to provide all those things that people brag about getting with pirated copies, still get pirated heavily. In short, we see zero benefit from trying to 'compete' with pirated copies.
If people are serious about trying to mvoe companies towards providing a better legal service, they need to heavily support those legal services that give the customers what they want, and heavily criticise people who continue to pirate when hassle-free reasonable legal versions are openly and easily available.
I don't see that happening one tiny bit. Every news story about piracy or intellectual property here gets tagged with 'greed' automatically. If that's the attitude of slashdotters to content creators, how do they ever expect to have their demands listened to?
I don't recall ghandi going out of his way to stay anonymous. In fact, he made a big deal out of publicly breaking the law, and accepted the punishment to show how the law was unjust.
Explain again how this woman is like ghandhi, because I just don't see it.
Really? I must have somehow been paying my rent all these years with pixie dust then. Me and the other indie devs who do game development full time all manage to pay our rents and our food bills. Explain to me how we are not economically viable, but companies like EA who often make a net loss somehow are?
BTW, most fulltime indies do it because they have seen how badly most 'proper' companies are run. By your definition I do not have a job, nor will I ever have one again, having seen how much more efficient it is to work for yourself.
Its a pity that slashdot cares more about the innocence of a single woman who clearly did download music in breach of copyright, and was facing a fine, than it cares about, oh I dunno, people who were rounded up in pakistan and thrown in guantanomo bay for five years with absolutely no evidence and no chance of due process, a fair trial or even knowing why they are there.

So any geek off the street is smarter than Bill Gates and Steve Ballmer.
I bet those two guys laugh like maniacs about comments like that, whilst sitting on gold plated thrones and guzzling Krug.
I have a legit copy.

Indeed. No wonder those dumb schmucks at microsoft lose so much money.
Hang on...

I'd also imagine that if they lived in a less litigious society, the aches and pains would mysteriously vanish.

have you looked at the evidence?

so what happens to the store, the musicians and the recoding engineers when everyone acts like you?
wow.
everyone in any creative industry throughout the globe does one weekends work and then retires?

If not, switch careers.
If so, stop whining.

have you ever run a business?
because if you had, you would realise that you only produce products in the hope that people BUY them.
the money to make a movie does not float down from the skies. Its an investment, made in the likely hope of a return.
If everyone behaved like you, who is going to be stupid enough to invest even fifty thousand dollars into making a movie that nobody will pay for?

Not exactly ghandiesque is it?
I don't recall ghandi going out of his way to stay anonymous. In fact, he made a big deal out of publicly breaking the law, and accepted the punishment to show how the law was unjust.

I guess getting free music is more important.
