    Because SCO GmbH Germany was
    a) not allowed to do so by order of SCO Inc.
    b) SCO Inc. did not give SCO GmbH Germany these small pieces of evidence.

    (yes, I spoke to the SCO GmbH Germany CEO, see other thread for details)

    The first part of your statement is perfectly right. I just want to add that

    1. There were many requests for an preliminary injunction, not just by LinuxTag (and they all succeeded)
    2. In all cases SCO has to be read: SCO GmbH Germany.

    Although your post appears to be some kind of flamebait, you are dealing with valid points.

    If Mr. Bremer (CEO of SCO GmbH in Germany) walks to the street and says "I personally believe that Linux is inviting the whole world to steal our code", it's okay.

    The preliminary injunction only applies to the doings of SCO and its employees in business.

    The short version (which omits many important points) is:

    "The world sucks" --> nothing happens.

    "SCO sucks" --> if you are a competitor of SCO, SCO might be able to request a preliminary injunction against this statement.

    "You suck" --> under normal circumstances, "you" might be able to request a criminal investigation for insulting. Of course, there are situations where "you suck" might be justified.

    Could you please specify why you think that there is a lack of freedom of speech in Germany in this case?

    (personally, I agree to this article 130 of the German criminal law which makes it illegal to deny the murder of millions of people under the 3rd Reich)

    This also allows any international company to politely ask SCO to send the licensing request to their German IT department. Or move the IT department mailing address to Germany for the same reason.


    Well, $700 USD per CPU are nothing compared to German income tax :)

    So if you sum everything up, surrendering to SCO might not be the worst outcome from a fiscal standpoint.

    They are not.
    the civil law system of each country in the EU is seperated. There are only a few links between them when it comes to civil rights.

    Most countries in Europe (not the EU. The Council of Europe is somehwat larger than the EU... And the continent Europe is larger than the council of europe..) have ratified the European Convention on Human Rights. When the national way of procedure (Appeals, Revision, national supreme court) ends and you still think your human rights are violated, you are allowed to go to the Human Righs Court in Strasbourg (France).

    This does not apply to the current SCO-case.

    It might change in the future.

    It's not the amount of the fine that's important. (Who gets the money anyway.) It's the 'official' trashing of SCO's accusations which is important.

    You too, my dear friend, misunderstood this fine. It was not because SCO could not prove anything but rather the other side could prove that SCO did not follow to a preliminary injunction from some weeks ago.

    This is still good news but it was not about SCO's claims regarding Linux.

    According to SCO-Germany's CEO, they were not given authorisation to present any proof to the judge. (Obviously, you won't find a German judge who signs a NDA). But all this was relevant *before* the preliminary injunction came into effect. The whole debate today was about SCO's efforts to comply with this preliminary injunction. You bette not mix those two 'battle fields'.

    it goes like this (only applicable in Countries with preliminary injunctions against SCO regarding their Linux statements):

    1. call the SCO HQ.
    2. ask them about ther 'Linux end user license'.
    3. The SCO person will answer "we can't tell you about this because a German court does not allow this."
    4. pretend to be surprised.
    5. hang up.

    6. call again.
    7. tell them that you actually read the preliminary injunction and it does not tell anything about the SCO-Linux-License.
    8. ask again to send information about this SCO-Linux-License to you
    9. listen to their suffering. ...

    and so on.

    I did it 4 times and the last time, they forwarded me to the CEO of SCO Germany. It's funny indeed.

    My dictionary says that "schadenfreude" is also an english word.

    (I don't know if the translation left the meaning alive but I think we are all waiting for a judge who finishes this SCO behavior by negating SCO's claims)

    It's more important that they have seen that they are lying.


    Please don't misunderstand this fine. This is not about the (doubtful) statements of SCO.

    SCO GmbH in Germany was only fined because they did not fully comply with a preliminary injunction which told them not to repeat certain statements.

    $10,800 USD seems a bit low, considering that SCOs lies and threats have probably damaged Linux companies and consultants many times that amount.


    You were right if this fine was for messing around with the Linux community. This fine is only because SCO did not follow a preliminary injunction promptly. Certain statements were shown on sco.de *after* this injunction came into effect.

    Depends on your expectations. On a boring day, there is nothing more exciting than discovering a forein language and playing around with it. The milage may vary but there have been many moments of success for me, when I tried to figure out the meaning of huge norwegian sentences :)

    Why so many german articles lately(as opposed to portugese, mandarin, polish or russian for ex.)?


    The answer is pretty easy (to a certain extend..): YOU DID NOT SUBMIT THEM!

    simple, isn't it? (okay, I may have skipped one or two steps)..

    Your first point is absolutely valid to a certain extend.

    While I am a German native speaker, the majority of the information I read is
    a) English
    b) German with at least 20 per cent English buzzwords.

    Every time /. is linking towards non-English sites, there is someone posting a translation in here. (t+5minutes: automatic ones like babelfish, altavista or google; t+20 minutes exerpts in a usable translation; t+1h a nice translation).

    This is actually a good thing and the people who are doing these translations are heavyly dependant on your feedback.

    From a pracical side, it would be not so nice not to point to non-English sites, when they are covering an interesting topic. As long as there are people here who are helping those people who have chosen to learn different languages, I don't see you being handicapped.

    Btw. do I hear you volunteering to answer stupid questions from non-English-native-speakers to explain rare english words which can't be found in an online dictionary for some reason?

    This would be a good point if I had declared Europe as one *nation* rather than one *country*.

    Go back 50 years in history when the German constitution was made. The free state of bavaria did not agree to this constitution - claiming the same as you did. From 'their' perspective, they did not have anything in common with people from northern Germany.

    On my passport as a dane it says Danish citizen, not a citizen of european union.....


    Look at Article 8 of the Draft Constitution of the European Union. Here is a link to the dansk version.

    Since European carrier rockets are in their fifth generation now, I wouldn't consider them "news".

    I'm living in Frankfurt/Germany. Last month I was at a study session in Strasbourg/France. I could have left my passport or my ID card at home. As long as your skin is white enough, borders within the Schengen countries do not apply to you. You enter the train in - let's say Karlsruhe - and you leave it in Strasbourg without having noticed a thing called "border".

    If I were a German of turkish origin, my experience would be totally different. German or French border police would have picked me up, would have checked my passport and maybe my pockets.

    Under these circumstances, it might be arrogant to say ist but for me as some kind of WASP, Europe has become one country.

    If you take it from a legal perspective, there is more evidence. About 50 per cent of the new laws in 'the German part of Europe' are more or less ratifications from European ones.

    Well, and nobody can take away my optimism that this European Constitution will come into effect soon. (Actually, this is not the first European Constitution but this is the first time they call it that way).

    When I read the German version, I remember that almost every page contained many pictures, screenshots and all these things which will blow up the file size.

    IMHO, presenting pictures in a usability study *is* justified and on my crappy system, Acrobat Reader survived, btw.
