Architecture changes over time, what is "right" for today becomes "wrong" for tommorow.
When client-server architecture was right, there was more bandwidth considerations, and various other problems that prevented peer-to-peer from becoming a viable architechure until now.
How does this ruling effect/ or is effected by BERNSTEIN V USDOJ case #97-16686?
The case was about a math professor, who posted code deemed illegal by International Traffic in Arms Regulations for his crypto class. The ruling states that "code" is protected under the 1st.
The ruling of the case is as follows;
"The government defendants appeal the grant of summary judgment to the plaintiff, Professor Daniel J. Bernstein ("Bernstein"), enjoining the enforcement of certain Export Administration Regulations ("EAR") that limit Bernstein's ability to distribute encryption software. We find that the EAR regulations (1) operate as a prepublication licensing scheme that burdens scientific expression, (2) vest boundless discretion in government officials, and (3) lack adequate procedural safeguards. Consequently, we hold that the challenged regulations constitute a prior restraint on speech that offends the First Amendment. Although we employ a somewhat narrower rationale than did the district court, its judgment is accordingly affirmed."
What if MS just told the government that their licenses have been revoked.
Which they could do, and if I was Bill, I would do.
Everybody seems to love the government for wanting to break-up Microsoft. Well what if it was your company that was beening told to break-up, and you had the worldwide power that Microsoft has. Would you listen to the Gov?
Besides if Microsoft didn't exist, most of you would have never known about Linux.
There is no solution, and a break-up is nothing, Bill will still be the richest person in the world, and people will still buy Microsoft.
The ban of Napster shows the lack of comprehension of the Internet by the universities. It is not the universities job to act as police, and they should not be held responsible for student's actions because of the provided Internet access. Furthermore, Systems Administrators should be more prepared to explain the legal issues regarding Internet law to the suits.
If anyone has free time(or remembered what it felt like), I'd love to see a web site geared for computer law, for SA's.

The computer industry is broken up into two groups.
1. Microsoft, and the ##### of windows users, programers, administrators, small businesses, big businesses, governments, and whom ever else whom happens to use anything that Microsoft makes.
2. All of the above, sans MS(I'm sure some of their employees also fit in this group), *UNIX*(all versions included) users, Mac users, everyother OS users.
One of the only rulings that I could see that would benefit everyone, including MS, is to force MS into giving away every bit of "technology" they have. This means opensource everything. And the great thing is, Linux has proven that you can make money without keeping secrets.

What can you do, close them down, sure, they move all of their 30,000 employees to Canada(not likely, but think about what you would do to save your company if you are the richest person on the planet. Make your own country). Oh, boy what will the US gov do then.
Also, nearly every government for nearly every country is dependant on Microsoft, and Microsoft related products. Are you going to tell them that no one can fix their software related problems? No more hot fixes.
Closing them is not a solution, it only creates more problems.
Here's a couple more questions I've been pondering. Why does a word processor cost more than an operating system? When does the NT shell get ported to Linux?

It's not only Microsoft, IBM has been looking into this as well. Sun is already starting to implement this, Jini. It seems that this is the future, although this news is old, they have been planning on using distributed computing for at least a year.
As for renting software, there is a great little store in College Station, TX, called Floppy Joe's.
They allow you to "lease" software, kind of like try before you buy. And that store has been there for over 5 years. Before most applications were released on CDs, you got a handful of floppies, and if you liked the program, keep it, they'll bill your credit card.
I can see stores like that popping up all across the country, that's a great idea.
But as for server side apps, blame it on the net. But the net is also a reason against this. Any one that is still using a standard phone line modem is going to be screwed. That is the majority of people. If Microsoft, or any other company is going to do this in full swing, they should take their billions of dollars and invest in dropping an oc3 line to everyone's house. They foot the bill for that, then maybe they can pull it off.
If you couldn't see Microsoft heading this way, you must be blind. IE, further integration each release. Windows Update.
Remember, the computer industry is not a consumer driven market. People make software, if you don't like their products, tough. They don't let you choose which features of which applications you want on "your" PC. It's all or nothing. You could buy a competing application, but you have to have the "Industry Standard".
The really sad part, most of this "Cutting-Edge" technology is still based off of stuff that is older than I am.
Even hardware is still lacking it's true potential, all for backwards compatibility. Look at SCSI. Sure hardware updates come around, but only once in a blue moon.
With today's technology, it's a shame to see hard drives that have spinning platters of metal, or plastic.
Intel, 3-Com, Adaptec, Nvidia, Sun, Microsoft, RedHat, Apple, SGI, and every other "major" player should all get together and re-design the computer from scratch. Including programming languages. That is where the millions of research dollars they spend should go. Forget backwards compatibility.
These companies can still make their products, and divide the research in to their areas of expertise.
Just my opinion on companies that could be smarter if they forgot about money for 3 hours.
I don't think it matters what our founding fathers intended this country to be, they've been dead for over 200 years. Quit trying to please them, and live life for fun and enjoyment.

Ask the people who make the laws if they want their lives tapped into. If so, broadcast their lives on TV 24/7. Add channels, see how fast they go crazy. When you want privacy, make it. Don't say you can't, break laws if you have to. Those cameras can all be broken, power can be turned off.
You might disagree with making crack legal, but if someone wants to use it, why should we stop them. You all praise the fact that you can make you own decisions, but you fear letting other people make theirs.
We should not stop people from hurting themselves, as humans, we learn from destruction.

The illegal search and seizure thing was out the window as soon as they said they could stop you for looking suspicious. It's a shame. But hey, just to catch one bad guy, we decide that is ok if cops block our roads. Last time I checked this country was still a democracy, but in real life it's socialist. The government should have no right to determine what is good or bad for us. Crack should not be illegal. You should not be taxed more if you smoke. Pot should not be illegal, Nor should pornography of any kind. According to the constitution, we must have a separation of church and state. IMO I would like all of our money to quit saying "In God we Trust". Also according to that law, we should have complete anarchy. There is not a law in this country that is not based in some way off of religion. As far as getting sued for allowing access to some web pages, tough, if you don't like, don't look at it. If it makes fun of you, get over it. Did you sue the six grade bully that was always picking on you? I didn't think so. Ignorance is not an excuse for the law, but there are so many laws now, that no one can know them all.
Here on slashdot we still have to worry about the repercussions of what we say, by legal means, and flaming means.
It's a really sad world, but none of us are fighting these laws, or government. We have the power as people to change things in this country. The only problem, no one listens unless your rich or lucky.
Insurance should not be mandatory, it's like telling you that your guilty before you get into an accident.
Most things that are legally mandatory, or illegal, are that way because of some industry makes enough money to prevent the change.
Face it, your going to walk the way they tell you to walk, and think the way they want you to think.
Ohh, and don't think changing presidents is going to help, there almost as powerless as the rest of us, besides your vote doesn't count anyway, not as long as the electoral college exist.

Most windows users pay more for software than UNIX users.
That is like saying black people save money at the store, it's racism on a technical level, which imo is wrong.
