Yep, same thing with armor piercing bullets (you know, some deer have thicker hides than other, you gotta be sure)
You forgot to mention the case where some losing crook wearing kevlar decides he wants my head. I want something that will kill that asshole DEAD. IMMEDIATELY.
This is correct. The RIAA members have a cartel. They have exclusive distribution and promotion deals. It's not a monopoly because there are many companies. Unfortunately, almost ALL of them are either members of the RIAA or are subsidiaries of companies that are RIAA members.
News flash: Adobe had nothing to do with that letter. The law firm that sent it didn't represent Adobe and was acting in compliance with (fscked up) German trademark law that allows independent predatory practices. How many times now have people posted this information? Everyone seems to be ignoring it.
OK, am I going to have to cut-and-paste this reply about a thousand times? Adobe HAD NOTHING TO DO WITH THE LAW FIRM! As many many people have pointed out, German law firms can go after anyone they like for trademark infractions regardless of whether or not they represent the company that holds the trademark. It's a predatory practice that's common in Germany.
Sure? DMCA is simply an implementation of the WIPO treaty and it was hoped (by the entertainment industry, not me) that this would become pervasive worldwide. Is Germany a signing nation on the WIPO treaty?
Mark my words, internationalism is the key to a world with nowhere left to hide from bad lawmaking.
Well, that and then clicking "Next" a few times. Either way, I assume that "instructions are instructions" and that if people can follow one set of instructions that they don't understand, they can follow another.
Mind you, I don't think I would want my mom installing packages on my Linux machine either--though she has done it with help from me over the phone when I needed something remote and I couldn't be there to do it.
When and if we ever get the GNUstep package installation software finished, it should become even easier to install binary software than it is with Windows "wizards".
Doesn't it depend on individual state laws? I seem to recall something about Texas suing programmers calling themselves "Software Enigneer's" some time ago.
Of course, I don't really care--if someone puts little pieces together to form bigger pieces, I consider it engineering. Doesn't explain "Sanitation Engineering" though, does it?
Uhm, why must everyone think they automatically have all these rights that no one has given them.
Because this is a sufficiently ambiguous case to suggest the need for a contractual restriction. Perhaps he signed one--I don't know. Either way, the car analogies REALLY need to stop: running RC5 is NOT stealing a car and never will be. Was it bad? Maybe. Was it REALLY REALLY REALLY bad?
If I come up to you and tell you that you need to do this, that, or the other--you'd either laugh at me, or punch me in the face.
Huh? I have often told people why they should vote for this candidate or that candidate or why they should be concerned about such-and-such an issue and NEVER have I been laughed at or punched in the face. And when is the last time you saw someone punch their TV when they saw a political ad come on?
What makes it all right for a group of people to do the same thing? Oh, that's right, it's the guns backing them up.
Have we changed topics?
If you don't think that gov'ts rule by force (even the US) take a look around you.
Yes, and your point is? If governments DIDN'T rule by force, things would be constant chaos. It's called law enforcement.
Hate to break it to you, but newspapers aren't any better than TV or the web.
Actually, I believe that they had to learn at least some Russian.
LOL!

This is incorrect. Even though Bizet doesn't have a copyright on this work, the recording label that recorded it DOES have a copyright.
Everything else you said was correct, however.

So, since the usage has dropped 90%, we can assume that it's no longer being used for infringing purposes.
Straight on. Trademark is the only so-called Intellectual "Property" that even comes close to being considered property because it is an asset.
That's why he said, "in the absense of all other evidence."
Adobe didn't hire them. They had *NOTHING* to do with Adobe.

There are a lot of differences between the "Barney" case and this case.
Hey! Don't include *ME* in this--I've been trying my best to get people to recognize national sovereignty as an issue and nobody cares.

Not really (to me, at least). But that would certainly seem to be the sticking point, wouldn't it?
(And sorry about the rudeness of the earlier post, hadn't had my coffee yet.)
No problem.
Can we assume that you don't believe in the corruption of human nature and subsequent need for restraint?
Mind you, I don't think I would want my mom installing packages on my Linux machine either--though she has done it with help from me over the phone when I needed something remote and I couldn't be there to do it.

Yes. Definitely a commie. ;-)

Are they not accurate? Please document.
is that power companies didn't just fail to build power plants in CA, they failed to build power plants in other western states as well.
Perhaps other states didn't have the demand (both current and projected) that CA had and therefore didn't NEED more plants?
The other problem with that argument is that the capacity in 2001 is adequate.
Document, please.
Power became scarce because sellers of power found it profitable to make it so, not because there is an absolute shortage.
Is there proof? Perhaps internal company memos that clearly indicate price fixing?
Are the environmental regulations in CA *not* more strict than elsewhere? This would make it more expensive to build plants.

Yep. "Keepin' the dream alive." ;-)
