  1. Words vs. trademarks on Web Ad Trademark Law To Be Retested · · Score: 1

This is a tough one, with that any company can copyright and trademark and term so long as no other company has allready thought to do so, it could soon be that we're so hideously restricted that we may have to start adding words to our language. On the other hand, in this specific case, how often does anyone use the word playboy or playmate in a search variable on the net without it being a direct relation to the magazine and the models? Honestly to parents go online and look for playmates for their kids? And how many women really search for playboys? I agree with one of the previous posts that thinks this case should go to trial and have the merits argued exhaustively, it's going to be a more and more prevalent issue, hell Comcast has the @ as a trademark, A&E has the ampersand, soon the courts will HAVE to weigh in and put some sort of guidelines in place for this issue. How in the hell they will do that I have no idea, I'm torn myself with wanting to tell the money grubbers to go screw themselves for thinking that they can somehow usurp the language by thinking their ideas are so unique that the word/phrase/punctuation should only be used when in conjunction with their corporate entity, but on the other hand, I can see an argument for someone who has scratched out a niche for themselves and then a pack of weasles come in behind them hoping to leech off of their success and name recognition.

Does he normally read cereal boxes and other various labels for entertainment? I was annoyed by the premise to be honest, the guy is only bright enough to supervise a production line, steals company funds and impersonates a company officer, he somehow helps his friends retirement account by buying him steak and lobster and then the boss sais either be a spy for us though you have allready stolen from us and shown your lack of loyalty to the company, or go to jail? Uh, are you #^$^# kidding me? And as for Sillicon Valley corporations producing superior stuff and not having to worry about the bottom line, uhm, No?? Most of the software from the "valley" is utter crap that's released too soon to be a truly working release version due to market and financial pressure. And as for guys with whip smart minds making a difference in the company, from reviewing history, those types usually get fed up with the corporate crap and leave to create their own start-up and do it their own way with their own corporate crap. Please, this book and this review is so not slashdot worthy, what next, the bio of Billy Boy??

  5. The RIAA, the file sharers and poor suckers.... on RIAA Prepares Legal Blitz Against Filesharers · · Score: 1

The truth is, both sides are somewhat in the wrong here, trying to stand up and be strident about the right to download and share something that is copyrighted, wether you bought a copy or not is a bit silly, I don't for one instant think I have the "right" to download music, software or anything else that I would normally have to pay a fee for, regardless of the reasons, has the internet made it possible and fairly easy to obtain software, music and movies without actually purchasing it? Obviously, does the fact that untill recently you had to bascially call the owner of the copyright and tell them you downloaded something of theirs without permission in order to get caught make it wrong for the RIAA to say it's wrong of us to do it?? No. The RIAA is not wrong (much as it pains me to say it) when it says that it's illegal to distribute freely copyrighted materials, period, where they are wrong and make themselves look like fools is that they try to tell us that their sagging sales are due to piracy, that is patent nonsense, their sagging sales is due to the immense ammount of peurile crap that they spend money promoting and distributing, net pirates are not the reason that the audio equivallent to an enema that Sony just spend 5 million marketing hasn't sold more than 10,000 copies, the music industry got used to putting whatever they thought was "sellable" on the fast track, print some t-shirts, some posters, put 'em on TRL and send them across the country for different banal and vapid DJ's to fawn over and hey presto, we got a winner, well the music listening public has stopped swallowing the rancid pap that the music industry extrudes and we're forcing people who have no talent or taste or vision to decide what might or might not be good music, that's why their sales are lagging, the fact that their heads are so hideously driven into their own rectums and they are so out of touch with modern tastes and sensibilities. Period, the other reason the RIAA is making themselves look the fool is their draconian scare tactics and bullying techniques, sueing and threatening children who have very little idea what the consequences to their actions are is simply stupid, kids today don't realise that file sharing is a crime and their parents don't have the knowledge to educate them about net ettiquette and laws, this technology was nowhere near as prevalent for people in their late 30's and 40's. As for the folks doing the deed, plain and simple, it IS illegal, it may be convenient and we may have gotten used to the ease of doing it, but that doesn't make it right or legal. Much as I have participated, and most likely will continue to participate, I do not go forward thinking I am blameless or innocent of a crime, I know damned well that I am doing something illegal and if caught well, grab my ankles I suppose. Anyway.. them's my two bits.. like it matters.

  6. Re:Prisoner rape is funny, ha ha on Blaster Writer Caught · · Score: 1

Uhm, well.. to me the thought of someone who has committed a crime be it violent or merely annoying being violated is truly hilarious and marvelous fun. Truth is, and this from someone who has served time, and no, not in the local county pokey with the drunks, speeders and wife beaters, but in the honest to god big-house (federal pen) The rape thing is really overblown and exaggerated, it rarely happens and then mostly to some real aXXhole. Real life, as should be a general rule we all apply is not like Hollywood and prison is not really much like American Me, it's more like American History X, you do your time, you keep clean and clear of trouble, don't make the wrong people mad and it's more boring than frightening. And to be honest, rape is a hideous crime, the rape of an innocent person is one of the most horrible defilements there is, on the other hand though, the rape of the douche nozzle who screws with my network speed, fills my inbox with penis enlargement ads or sends me viruses.. that's something to put a smile on my face, and I hope it's a dry penetration as well, nothing like a few stitches in the ol' mud whole to keep your mind on the straight and narrow. shrug... lighten up...
