I work at Gamestop, and I can tell you that there is a lot more buzz about the PSP than there ever was about the DS. We had extras of the DS, we have plenty of them lying around now that we can't get rid of as a matter of fact. The PSP? Nope. First and second shipments, both reserved out. There's a lot more interest from consumers, and Sony has been hyping this (at least to the retail outlets) a lot less than Nintendo hyped the DS.
Everyone keeps assuming the PS3 will have backwards compatibility, but that's by no means a done deal. The PS3 will be a much more significant hardware modification than the PS2, I wouldn't be surprised is Sony just gave up on it and released a newer, smaller PSTwo (just like the little white PSOne) that everyone can play their games on. They can do it, they're the market leader.
It's quite essential for the prosecution to show intent to attain a monopoly on Microsoft's part, which can only be done with this kind of evidence.
By your logic, evidence in a murder trial establishing a motive would be thrown out, as the defendant was not yet a murderer at the time.

What? I thought the whole point of the Final Fantasy games was that there was no interweaving plot line to stray from. Each game is unique.
