they can but they just dont want to... why would they enable their competition?
people always jump to the conclustion that their mechine has been hacked when all in all it's just spyware. i've cleaned one mechine up that had 2400 infected spyware files, between adaware and search and destroy.
Have no fear someone is trying(key word trying) to stop this. They can be found at www.eff.org . so hopefully they can save us from the mighty RIAA
