The thing is that a "free commons" cannot exist for these very reasons. This is why society devolops things like laws, courts, customs, zoning, and a host of other ways to manage resources and disputes.
It is only in anarchy where this would hold true. Society needs these things to keep the individual in check.

My feelings exactly. When I tried to point this out on the Matrixfans.net site, I was roundly flamed. I guess I am not a "true believer".
