Source code is pre-compiled (before being compiled) code in the form of lines of text, usually with comments. It can be compiled into code that can run but can't be read (open a binary in notebad, figure out what it does... it's basically unreadable). The Windows code on users' PCs is all compiled code.
But most people I know that downloaded it went through a VPN, used that to connect to another VPN, used that to connect to a proxy server and then download the code. It's still trackable(depending on the VPN providers and the proxy) but way too much work.
I agree that it was wrong to release the source code without permission, but I disagree with you sueing the one who distributed it. If you have a problem with your computer's security and feel the need to sue someone, sue Microsoft. You'd lose though, you've already signed an agreement excusing them from practically everything.
I have a feeling if the source code to my linux distribution was ilegally released (its not finished, and MY software isn't free until I say so) that the FBI wouldn't give a shit.

These problems shouldn't exist to begin with. By distributing it you are encouraging microsoft to fix their errors and actually create a decent operating system. This is by far the most helpful thing that has happened for microsoft customers. There will be a time when things are dirty to begin with, but throwing mud on a dirty man makes him want to shower sooner.

Come on... this is Microsoft. No matter how good of a deed you try to pull, they will try to sue the hell out of you for it. Give them a better, modified, version of the soruce and they'll first sue you for having it to begin with. And then they'll reject the proposal because there is way too much code for them to want to read through and make sure only their backdoors are in, and not yours.
That zip file has no kiddie porn, credit card numbers, bank statements, or letters to microsoft's stalkee. It contains instructions. Instructions for how MY computer functions. I believe I have every right to know what's going on in my computer, and now I can.

But with all these viruses released microsoft will feel pressured to actually patch these and make their operating system actually good (or as close as they are capable to making it good). I believe this was done in an attempt to improve peoples' computer experience. Sometimes you have to get dirty to get things done.
I'm making my own distro right now. my source code folder is 5.9GB and that's including the object files. 40gb is excessive. I think microsoft basically just admited to having way too much bloat.
I've read in another thread that Microsoft released bogus files onto kazaa. I decided I'd try to get one of these bogus files and see what they were. I found a 100mb ZIP file which was obviously a fake, everything's saying it's zipped up to like 200mb and extracts to 600mb. Using my handy dandy "file" command I discovered it was an mp3. A 100mb MP3. I played it and it was some 3 hour long thing full of absolutely nothing.
For those of you intrested, the filetype was:
MP3, 80kBits, 22.05kHz, JStereo
If it was intentional, Microsoft wouldn't have flooded kazaa with bogus source code downloads. I think it would harm microsoft's credibility as far as "windows is more secure" claims more than it would hurt interoperability projects. A defense in such an accusation is easy if you didn't actually do anything wrong.
