Every appeal for a new law that lacks any logical basis must instead have an emotional jolt. That is the driving force behind many of the police powers that the state has frightened the public into approving.
Because the people who *love* using the government to fix social problems can rarely find a logical reason for their power grabs, then usually parade out a bunch of kids and use them to convince the public that the law will protect *them*.
Just how that occurs is never challenged by the press. It occurs even less now that we are in a War on Terror(ism). All you have to do to get any law to pass through Congress is to claim Al Quadia will find a weakness and will attack without passage of "this law to fight Terrorism(tm)"!
Thanks to you we can all watch it happen all over again!
True, but I suspect that due to the time of day it will probably not reach the hits per second that it did in the *two* other occasions that the server was stressed.
And this one wasn't associated with a post that emanated from their department. That ought to keep the admin busy for a few minutes.
Yahoo is in no way responsible... The suit should be dropped.
Thanks Your Honor.
I think I will wait for the "real" judge to rule.
This is no different than if the ex-boyfriend had taken a nude photo of her, taped inside of a truckstop bathroom stall with "I'm a slut, call me" on it. The truckstop would certainly not be liable.
If the truckstop was asked to remove the nude photo and did nothing, then how would you rule?
No, the word you are looking for is "provocative".
Noone can be so stupid can they?
I don't know. Are you trying *really* hard?
"Is.NET another Microsoft vaporware?" I sure as hell hope not , as I currently have well over 5 million lines of.Net code deployed and in production on applications everywhere.
Then if Microsoft abandons.NET then you are kind of screwed, aren't you?
Next time you might try taking the less offensive route to a discussion.
This study was obviously funded by Open Office and Linux. I am so sick of Linux and Open Office "buying" the results that show their products are better than Microsoft's. This report is so slanted in its analysis that I can't even begin to chip away at all of the errors.
The women does not legally own all nude pictures of herself. Her phone numbers do not legally receive any special priveledge either, or phone books would be outlawed.
Your points are well taken, but the problem with this case is that her ex- used the profile to solicit sex from strangers who showed up at her workplace. Posting the information and pretending to be her is fraud.
Posting nude pictures of her by itselfisn't something I would consider actionable, despite being an asshole-ish thing to do.
First you have to enrich the fuel. Then you have to irradiate the fuel. Then you have to separate the uranium from the plutonium. Then you have to build the device (tricky is an understatement).
If you just use uranium you still have to mine, extract, and enrich the fuel. Then you have to build the trigger and test.
They aren't responsible for what other people do with the web space any more then a Bar is responsible for drunk driving.
There is plenty of case law holds that bars and taverns are liable if they knowingly serve people who are visibly intoxicated who then drive and kill or injure someone on the road. If Yahoo was asked on more than one occasion to have the information removed, they could be held liable.
As I said, that is what the court will decide in this case.
Stalin was a socialist. Hitler was a socialist.
Both used the State to advance thier political ends.
Fucking socialists, right or left.
Socialism includes state housing, healthcare, and welfare.
And special legislation protecting pet industries.
What you are thinking of is right wing authoritarianism, also known as facism.
Joe Stalin loves your definition.
Please use proper terminology when trying to state a flame war over political ideology.
Stalin was a socialist. Hitler was a socialist.
I don't need your flawed definitions to understand socialism.
How are RIAA, MPAA or any branch of your government "socialist"?
Are they *supporters* of free market principles?
They are fucking socialists.

Fucking socialist bastards.

Not exactly a map, but a nice graph of a site getting slashdotted.

I guess you might want to RTFA.
Yeah and it was supposed to be funny.
;)
Some people have NO sense of humor!
Then there's the Canadian taking it all seriously...
Damn Canadians....
Some states, California for example, confer upon people a "right of publicity".
Yeah, I consider that but I don't think Oregon has such a statute.
Good point though.
Clearly you missed the point of the Article.
No, I clearly got it.
You clearly missed the last line in my comment.
Nothing like a couple of assholes on the Internet ruining stuff like this for everyone.
Agreed.
Unfortunately we are all bound to the lowest common denominator in life.
You were joking right ?

Next time you might try taking the less offensive route to a discussion.
Aye, mine is in similar shape.
Hope that it gave you a well-earned, late afternoon chuckle.
Amazingly, this time you were.
Statistics are great, aren't they?

And yes, I do think I'm funny.
I think you mean "ore", not fuel.
Fuel is fabricated, not mined.
"Say 'hello' to my little friend"
Where Yahoo's real risk is at, is by being understaffed.
Which is why I believe they will just shitcan their adult groups section.
Too much hassle for too little return.
They could dispense with all of the steps and follow your advice with a radioisotope source stolen from a commercial vendor.
No nuclear fuel needed.
The centre of New York, Washinton, London is some very expensive real estate.
Which means that it will be cleaned up quickly because it is so valuable.
What if he didn't steal the photos? What if he took them with permission while they were still dating?
Okay, but she probably didn't consent to his posing as her and soliciting sex on her behalf.
That is one reason why she asked to have the profile removed.
Her boyfriend didnt photoshop the nudes, she at some point consentually allowed them to be taken of her.
If you RTFA you will see that he also posed as her online and solicited sex from strangers who showed up at her workplace.
The fact that he retained possetion of the nudes and posted them is this stupid lady's fault.
If all he did was post them, then I might agree with you.
This is another "i spilled hot coffee on my self now im going to sue you!" deal.
Yeah, I'll check back with you in 25 years when it is your daughter who is being harrassed at work.
Should yahoo have to take the profiles down?>
Yes.
The women does not legally own all nude pictures of herself. Her phone numbers do not legally receive any special priveledge either, or phone books would be outlawed.

None of this is cheap nor safe to do.
They aren't responsible for what other people do with the web space any more then a Bar is responsible for drunk driving.

As I said, that is what the court will decide in this case.
People like this woman should take responsibility for their own actions.
She didn't post the photos in public.
You make nude photos of yourself then sorry, if they get posted somewhere its only your own fault and nobody else.
No, if someone steals your property it is the perpetrators fault.
No scruples, and no right to sue.
So whatever you do as an adult, with another adult, in the privacy of your own home, should be considered by a court in a civil action?
Dude, I think you are way off base on that one.
