the problem with most of the posts on this subject is that they make legal arguments based on facts as commonly understood and reported in the media.
this approach fails to take into account the fact that money, like mass, exerts a force of gravity. federal courts are like distant planets, and one of the ways even more distant planets can be discovered is by observing the gravitational perturbation of the orbits of the nearer planets caused by the presence of the farther, unseen planets.
there's a big planet with a lot of money influencing this case, and no law/fact analysis can be adequate without taking this planet into account. it's the planet with the most to lose if sco loses and linux continues to gain ground.
