Well.. yeah, Nintendo CAN earn money from them by including them with newer games, I suppose (look at Zelda: Wind Waker.. there was a limited edition that included a GC port of Ocarina of Time, and I went to the trouble of buying that for the game).
But for the most part, you are right. I think there should be a limit on how long these games are copyrighted for, same with all computer software (although games would be most suitable.. Playing a 10-year old copy of Tyrian is still fun but I can't see why anyone would want Windows 3.1).
